Help solving a payment issue
Hey there felas, thanks for checking my post, I have a little doubt regarding a cpa network that sent me a letter saying they are not going not pay, I will keep the name of the network to myself to avoid any problems right now but will post it later if the issue does not solve itself
it happens that I sent around 25k on traffic on jan and feb, they delayed the payment a lot, and right now they are telling me that they are not gonna pay for the traffic because its fraud, the thing is, I sent qulity email traffic but i got like 25% of leads returned or people that where no longer interested, I assume that the quality was not so good, but they still have around 20k worth of leads that where valid for the advertiser and they are just playing dumb... I represent ****** Media Group, LLC in its corporate and litigation matters.
This letter is to inform you that pursuant to the Performance-Based Ad Network Agreement (the "Network Agreement"), entered into on behalf of ********* ("You") on or about December 10, 2012, there is a hold on all outstanding Commissions payments for EDU traffic generated by You.
Please be advised that to date, ***** has not been paid for any of the EDU traffic that was generated by You. According to the applicable advertisers, non-payment is the direct result of the dismal quality of the traffic that was generated by or on behalf of You. Worse yet, the advertisers in question have threatened to stop working with **** by virtue of the associated traffic quality; and allegations of potential fraud.
As set forth in the Network Agreement, **** may withhold payment to You until such time as **** has received payment from the applicable advertisers. Please understand that if and when we receive payment for your traffic, You too will be paid. But based upon the foregoing, we cannot, in good faith, assume the risk of making any payments to you at this time.
In light of the quality of the traffic that has been generated by or on behalf of You to date, we cannot allow You to continue to push any further traffic on our behalf. Moreover, your account on our Network will be terminated effective immediately.
This letter does not purport to be a complete statement of the law or facts surrounding this matter and is sent without prejudice to ***** legal and equitable rights, which are expressly reserved.

my question is... how can i fight for the payment? i spoke to my manager and he is on my side, he thinks this is bullshit on their side and they are just playing dumb to not pay me... that amazes me, the real problem seems to be the CEO or someone up the food chain
anyway I have heard stories of people facing this kind of situations and after some legal fight they get paid, they owe me 20,000 so i think its worth fighting, any advices on this?? i will really appreciate it
