Images "underneith" Adsense Ads?

I've seen sites where adsense ads look like they are placed on top of images so that they are "framed" by the image.
Does anyone know if this is against TOS (no images besides ads)
or if its not, then how do you do this?

if you ask about violate google TOS or not,..
i could not answer it,..

but if you want to know how to make it,..
just leave comment on those site, ask him how to do that
