These tools only search for indexed pages and f a website has indexed pages on Google, they show 'Not Penalized' and if the website don't have indexed pages, they return "penalized" . however its the last factor for determining if a website is penalized.

I use this tool http://tools.lilengine.com/penaltychecker/ for Google Penalty Check. It also show how much penalty you getting. |

lol it says my website is banned, but yet my site still appears in google searches. This tool is a possible fake, also I haven't done anything to even be banned all my stuff is legit!

This is junk. NO site can tell you for a fact if Google might have applied a negative flag to your site. It is highly unlikely your site was flagged anyway unless you are a big player.
