Can Trademarked Domain Be Used In Other Intentions?

Crucial is operating memory manufacturer for computers. Their domain is crucial.com. There is another website that uses this domain name: crucial.co.uk but it has different purpose, it has something to do with investing.

Also crucial is a generic word.

Question:

Is the latter website is still in domain name infringement?

That's a good question for a lawyer. On this board you will get only guesses, and here's mine: that because 'crucial' is a generic word and because the memory manufacturing company's actual name is Micron Technology and Crucial is just their consumer sales brand name (Micron Technology - Wikipedia, the free encyclopedia), they likely wouldn't go after crucial.co.uk for infringement. However, would this argument would hold up in court if they did decide to sue for infringement? I don't know, ask a lawyer.

So there are brands and consumer brands? What is difference? It's like Intel is a brand and has consumer brand too?

If the name of this company in the UK is also Crucial, then I would say they have every right to use it.

But then I am not a lawyer, so this is just an opinion. And you know the thing about opinions, they are like a$$holes, everyone has one and they all stink.
