Default Trademark = SEO paradise?

It seems that a lot of people, including myself, have had a lot of luck getting on the first page of google when we include the trademark in our EMD, for keywords that get well over 50,000 searches.

My concern is about the company who owns that trademark coming along and not only telling me to take my site down, but also asking for all the money I've made, and maybe even worse. Which is why I currently don't own a trademarked domain anymore.

How are so many people getting away with a trademarked EMD?

I'd like to get back into the business, if it's safe.

What's this Trademark EMD? Sorry but it's the first time I encountered such thing... Can you briefly describe it to me? You said its part of SEO right?

EMD just stands for 'exact match domain'. Which means your main keyword is in your domain name.

WalmartGiftCard.com is an Trademarked exact match domain, if you are selling gift cards to walmart.

Not every company actively pursues sites that infringe on their copyrights so it's a coin toss.

Basically some companies will take EVERY domain that infringes and they have lawyers on standby to take them. Other companies just don't bother, but the thing is one day they might turn to their lawyers and say, alright go get all those domains that are infringing on our trademark and then you lose your site.

If you want guaranteed long term income work on a BIG site and keep building links to it. If you want a short bit of money that you could lose at any second register a domain with a trademark in it

Simple...

I've said it plenty of times here on WF, you don't need an EMD.

Instead of an EMD, create an internal page with your keywords.

hxxp://www.mydomain.com/walmart-gift-card/

Don't point any backlinks at your index page.

Do point all your keyword anchor-text backlinks at the new internal page .../walmart-gift-card/

Well, what about building backlinks with Trademarks in the Anchor Text? Isn't this infringing on copyrights as well? I wonder how many people do it anyway though. Probably an astonishing number. Do you not recommend building these type of backlinks?

Wouldn't putting domain.com/walmart-gift-card also be infringing on trademarks as well?

Yup, this is what I am doing. I won't rank as quickly as I would with an EMD, but I will not have any lawyers coming after me!

If I wanted to build external backlinks pointing at your site (not my site), I could build links all day, every day!

Can anyone prove you built the backlinks? The answer would be no.

So if my handle 'friendclk' is trademarked by someone else. But I build the site: mydomain.com/friendclk, and I'm ranking #3 on google, right below the company, I can sell whatever I want, and the company can't stop me?

That would be just as good as what I was doing, before I stopped.
