If it is trademarked, it is sueable. However IP and trademark laws vary between countries, its worth getting legal advice if you keep doing this..

I think we need to make a clear distinction between companys that may want to sue you, those who wouldn’t bother, and those who would actively encourage you to use their brand name in your domain name. If it’s a more traditional product company such as Sony, Canon, Nike, that’s potentially a problem, especially if you manage to squat a site with one of their product names, eg. www.adobephotoshop.com What about something like NikonCameraReviews.com? I’ve seen these sort of sites lots of times. They don’t seem to be going anywhere. Some companies will clearly turn a blind eye, as long as the site is clearly “unofficial”. A friend of mine runs a community website called AbletonLiveDJ.com. It is completely seperate from Ableton Software Inc. Ableton are aware of the site, and are very positive about it as it raises brand awareness, amongst other benefits. If you’re promoting a clickbank product, chances are they will be more than happy for you to do whatever it takes to flog the product. Funnily enough, when doing keyword research, it is often phrases containing brand names that stand out in terms of high search count relative to competition. |

I tend to agree that using a trademark name in your domain name will definitely bring the law down on you. If you are not saying anything bad about them then I don't see why you couldn't use the name but linking to them may be different. To be correct, get some legal advice it may be better than being sued.
