Default How do you avoid Copyright/Trademark infringement?

I notice the vast majority of people recommend pursuing product related niches for sites monetized with Adsense.

However, I also notice a lot of people specifically stating NOT to use EMDs with Copyright/Trademark names, such as Nike or Walmart. (i.e. www[dot]nikereviews[dot]com)

How do you create product specific sites that involve brand names and keywords like: "Nike Air Max 100 Reviews" without violating any copyright/trademark laws?

(FYI, I have searched for more general EMDs, such as "www[dot]brownhighheels[dot]com", but every general category is taken for product niches (at least that I can find), so I am stuck use very specific product names.)

Using brand/trademark names in your domain is like building your buisness on sand. I would suggest to grab PMD (Phrase Match Domain) and grow it.

I'm not too sure that Nike Air Max is violating the law, if you really concern about that, just use a general name like sport shoes reviews, athletic shoes review, and create a sub page call "Nike Air Max 100 Reviews", I think that's another way to go!

I guess this is my question.

Every popular brand name EMD seems to be taken, but at the same time every says don't take them. I don't get it? Are these hundreds of thousands of sites that are violating trademark names just getting lucky? Because I guarantee you that sites like "mcdonaldscoupons[dot]com" are making tons of money (that was just an example by the way, no clue if it exists).

So, just to clarify, if you're creating a niche site for a product, let's say, "Bissel Vacuums", then you would never choose a domain name with the word Bissel in it? Instead you'd just go after phrases like ,"bestdoghairvacuum[dot]dom" and the like?

Again, I'm just confused why everyone says things like Using brand/trademark names in your domain is like building your buisness on sand," but then I saw thousands upon thousands of these sites ranking high.

I would stay away from branded EMD's if you are thinking about long-term business.

This is a legal issue of which can possibly result to the ff:

loss of the domain
loss of any work put in to building a site on that domain and
possibly even a financial claim for breach of trademark

Thus it would be best if you would consult a trademark attorney

It's not a good idea to register a domain name with someone else's registered trademark. nike-reviews [dot] com would not be a good idea but there is no reason you couldn't have a page on your site for a term with a brand name in it. ex. - athletic-shoe-reviews.com/nike-reviews would be fine.
