Hey, I'm planning on setting up a blog in the music niche, and provide my users with the latest songs, videos and albums. I'm going to provide links to download the songs, but not for albums as I know albums are not to be shared, that's what reputable music websites are doing at the moment. However, I wanted to know the legal issues revolving the songs. I will not host them on my server. I see those kinds of website alot of times on the Web, and I see they have ads. Would I be able to put adsense onto it? Or preferably another ad network? I need feedback from someone who had experience in this field. Thanks. |

You'll run into legal issues, sooner that you can say "copyright infringement" ... Quote:

Well I can make a disclaimer and announce all the links are from third party websites and that I have no association with them, and specify that the links are for promotional and critique purposes only. And if someone wants to remove a copyrighted material, they can contact me with proof and I'll take the link down. But usually artists are well aware of that, and since I'm also promoting their albums and don't actually give out illegal download links to them, they will be happy and there will be no problems since anyways all the money is made from albums and concerts. |

So in essence what you are saying is - "I know its not legal but it is the artist responsibility to notify me to follow the law because I am a really nice guy and I am "promoting" for them." I think with most content it is not an issue until you are sent a cease and desist but with music and the laws released specifically for it you can get in trouble... unless you are not making money in any way shape or form from what I have heard.

You will definitely run into trouble unless your dealing will more indie type bands that give you written permission to post up there albums. It not, the label will contact you and ask you to take it down or they will take action in court.

You could always offer album reviews and interviews and all that would appeal useful to a fan. Monetize will amazon digital album downloads or something of that sort. Just an idea..

What about if I don't give out the download link for the single, but my audio player linked to it so people could play and listen the single. Then I would put a link to order and download the single from itunes or amazon, and a link to pre-order the album.

Linking to music that's copyrighted is against the law in most civilized countries. Look into how long of a sample you can use and them pimp that affiliate program for the download!

Be smart, use something like the Amazon music sample player on your site & get payed for it. You don't host anything (Amazon does) & it's all legal. |
