Hi Warriors! ![]() I'm confused Warriors - As it applies to FLIPPINGa site, built on one of these themes? (*cough*) I see FTthemes and Newwpthemes (dot com for both) both indicate their themes are "free." As well being under creative commons license 3.0 (That I understand - No problem, however...) However, when I look at the "terms" for both sites it says; Quote:
the say thing? - honestly, I do read terms often, however this is the first time I have ever taken the time to read the terms of a "free theme." Question - ABOUT FLIPPING A SITE; If I sell a site (flip) I build on a FREE THEME, must I indicate to the buyer; YOU ARE NOT ACTUALLY PURCHASING THE THEME as part of the sale of the site? I think that could easily blow the sale? Your understanding and feedback would be greatly appreciated! Danni~ | |

Sites created using a theme are being sold as such. You are not selling the theme. You are selling a site using the theme. I don't know why the person buying your site would object to a free theme if they want the site. Wordpress is free. You are not selling wordpress, you are selling the site that uses wordpress. You are not claiming the theme is yours. You are claiming the site is yours. If the theme is free, you need to follow their rules. But that has nothing to do with selling a site using a free theme. When installing a theme and using it, you are not taking intellectual control of the theme. Anyone online buying site would know they are not buying a free theme. If they think that, they are too far gone. They need to keep their day job. I can put a twitter feed on my site. That does not mean I am claiming I own twitter, nor the script that pulls the feed in. I don't think you will have a problem, that will just confuse your buyers.

thank you for the explain Paul - very much appreciated! Nice elaboration. thank you papa - that sums it up! I'm going to ask anyhow - when it comes down to the reality of "ownership"; when you actually buy a theme from a theme maker like Woo or Elegant themes - do you possess any form of "ownership" that a free theme is void of? (just trying to understand the true "give and take") I understand that they do not own any "wordpress" exclusive rights. But, is there some "difference" with a theme I might purchase, rather than a free one: in that the free ones retain more "rights?" Thank you so much ![]() Danni~ |
