Fellow Warriors,
I've been receiving a significant increase in emails and PMs (and even phone calls) that are essentially asking for free legal advice. So I wanted to make this post to clarify a few issues.
First, I do not give legal advice on the forum. Posts you see me write are about general legal issues and topics. Similarly, if you email or PM I may respond with general information. But I cannot give specific advice to your situation.
Here is an example: if someone asks is it legal to use a trademark in a domain name then I can respond with useful information about what is proper and improper - and why. (This has been a hot topic so use the forum search to find my many posts on the issue).
But, if someone asks is it legal to use a specific domain name (eg, ebay2.com) then I cannot respond. It puts me in a difficult position, and you might get slightly annoyed if I do not fully respond, or do not respond at all.
Second, my posting a response to your message on a thread, or responding to a general message does not make me your attorney. You can only become a client of my Law Office if there is a written agreement with my office.
Third, I won't message you asking for free products, so please respect my time and the many thousands of hours (and tens of thousands of dollars) it took me to become a lawyer and become well-versed in IM issues over the last 20 years.
Fourth, this may sound inapposite to the third point and counter-intuitive, but I do NOT post on the forum trying to get legal clients. Anything I want you to buy from me is listed in my forum signature. The omission of a link to my Law Office from my signature is intentional. My postings are simply to help you and others have better, more successful marketing businesses where you make money and do not get sued.
Fifth, the forum is my client but I do not make posts in that official capacity.
Finally, despite all of the above, please do not hesitate to continue sending me messages when you see a problem on the forum or a potential legal issue with a WSO or something else that is happening.
I don't mind general messages at all, but please understand my concern about the requests for specific advice, or misusing general messages with the goal of trying to get legal advice.
Thanks for understanding,
Brian Kindsvater
