Default Facebook images legalities of copying them?

Hello all,

Had a question which I was hoping someone would be able to answer, I am thinking of setting up a site kinda like Hot or not but with pictures from girls on Facebook obviously I don't want to get into to much details or someone would just take my idea.

Anyways if I am friends with someone of Facebook is it possible to upload their picture to a website. I mean they might not even know but in terms of legalities can I do this? I know a while back I got in trouble for getty images.. well not in trouble but I got asked nicely to remove a particular image. What are your thoughts on it? I doubt facebook would be to happy but they might not even know.

Palmer999 Have you actually seen the social network film and how (apparently) facebook started? If you haven't you must if you serious about pursuing this idea. You will want to pay close to attention to the part where he's sat in court getting penalised for mishandling data (i.e. images)

... and by the way, there's a few apps on the market that do what your suggesting (fit or fugly, anyone) check them out

Yes I know there is but if I have the person's permission to copy there images then it would be okay? If these apps are doing it what gives them the right to use the images?

I have seen the film(was quite good actually)

Yeah I enjoyed it too.

I suspect a few haven't got caught out yet while others have a sneaky permission process, where your clicking accept without seeing line 1038 of the TOS which says the image is the apps property and not yours... In the same way content uploaded to YouTube, isn't your content it's YouTubes, you only need to look in the terms of service which is why all the music producers are getting all whinney.

Yes, that means you can download a video of original content from YouTube, turn that into text and sell it without braking TOS. Though I don't recommend it, unless you enjoy spending time in court and spending millions on lawyers.

Well surely there is some way of doing this? I would say whats the worst that could happen but I would imagine Facebook would not be to happy. Hmmm there must be an easy way around it because I have a great new idea

Start by doing market research, look at home many apps already do this, how many are succeeding and how many are failing and try to get a number for how many are launched in this space each and every month and look at how they do it.

Furthermore to my last post I would think about speaking to a few warriors how have legal experience or have services which provide this for the im space.

It's certainly do-able BUT currently I think it's risky. I can't emphasise enough just how much an issue it is to be caught mishandling information which is not yours, or claiming ownership without proper consent.

You only need to look at how lose and ambigious the Californian Fraud Act is to see how you could end up in deep water quite innocently and the minimum fine is 250,000$

Had a brainwave recently, great idea I will look around but as I said the idea is pretty new. It is quite popular on Facebook at the moment but I want to put my own touch on it.

If I personally wasn't to upload the pictures but allowed users to upload saying something like

"By ticking this box you deem that you have the rights to this photo."

I could also have disclaimer saying I am not responsible for what is put on this site? I believe if then that it would be the user's fault for uploading the pics not mine
