Post Someone stole my content...now what??

I just found out that someone took my sales copy word-for-word from one of my WSO's:

http://www.warriorforum.com/warriors...only-10-a.html

Their site:

ServiceBacklink

They even stole my testimonials and kept my Warrior username in the copy!!

Anyhow, I sent them an email asking them to take it down, but is there anything else that I can do?

I have had content stolen plenty of times, and even backgrounds and graphics i created stolen right off my site. They say imitation is the sincerest form of flattery, but I did not feel flattered as they gave me nor my site any kudos or thanks at all.
You could contact them and confront them, although not sure how effective that might be, or maybe compromise and offer to help them write something more unique for their own site?
Or even just let them have your old content and write something fresh for yours?

Is there an internet organization that is taking care of this problem? An org that would punish copyright infringement cases...

I hope there is one.

Hi royljestr,

I'm really sorry that this has happened to you. It is not flattering at all and when it happens you go through a whole slew of feelings. For me it was a mixture of anger and powerlessness.

One thought would be to do a whois on their domain and find out the registrar or possibly the web host (this may be their own server telehoused at an ISP so it doesn't always work). If you contact the registrar or web host provider and let them know about this infringement they have been known to turn off sites before (or in some case email owners asking them to remedy this).

Another thought (out there I know) might be to contact PayPal and complain. I find it hard to get anything other than an automated response from them these days.

I still see content I've written on pages that are not mine complete with my name and everything!

Also, I've sent you a PM regarding your service.

Regards,
Rob Francis

Four words for you:

Digital Millenium Copyright Act.

Send their webhost a notice citing the act. Their site will likely be down ASAP. They stole your work, their host is facilitating the continuation of the theft. And their host has bigger pockets and more to lose than they do.

But if you do, keep this in mind: IANAL. That is, I Am Not A Lawyer. Don't even play one on TV, let alone the internet.

Einstein once said: "Two things are infinite: the universe and human stupidity; and I'm not sure about the universe." Winston Chuchill said, "If you are going through Hell, keep going." Someone else said, "Never be afraid to try something new. Remember, amateurs built the ark. Professionals built the Titanic."

Well.. they didn't copy your WSO word for word...

Contact both their hosting company and if that fails their ISP.

Or...

Issue a DMCA Notice against the offending party. Details below...

Google will often punish duplicate content by not indexing it. However, that won't help if the copycat is buying traffic.

Hi royljestr,

I truly feel your pain. Pete's strategy is on track.

In addition, if you have funds available, you may want to retain an attorney versed in Internet marketing law to do the heavy lifting.

Below are a couple of attorneys I know to have the goods:

1. Bob Silber

Internet Marketing Law Products
Attorney Bob Silber Legal Services

2. Mike Young Esq.

Internet Lawyer - Texas

Both are very competent.

Personally speaking, when it comes to legal matters, although I understand legal strategy, there are lots of "gotcha's" that can easily trip you up.

So if the matter is enough of a tick under your skin, you may want to retain an attorney who knows exactly what to do.

There are several issues (and opportunities) that I see, but talking to an attorney would be your best strategy.

I've used this tactic when people stole artwork. Be nice, be firm, make sure the copy of the complaint gets to the OWNER of the server... not to the webmaster of the site.

...you did have a copyright statement at the bottom of your page, right?

And is this guy an affiliate of yours? If the book is an affiliate book from someone else, contact the person making the book available and have them remove this rash person from their validated affiliates.

Thanks for all the great advice! I went to Lori Kelly's thread and found reference to this blog post which gives good same DMCA complaints:

http://domainingdiva.com/legal-issue...ipoff-artists/

So I found the host and contacted them...we'll see if anything happens

And yeah, I just noticed that he is charging $20 too...well at least he changed SOMETHING!!
