Online store selling smoking related product

Hello all,

Im new to the forums as well as internet marketing and naturally, I've got tons of questions.

But on to the most pressing of those questions.

I am looking to start a site that sells a smoking related product that I have designed. As it is mainly used for cannabis use, it falls into the same category as a lot of sites selling similar paraphernalia...

I'm wondering what steps must be taken to ensure that i am operating a legal business and that i am not breaking the law. I know a business like this is definitely capable of being a profitable one if done correctly and believe the first step is to rid myself of as much liability as possible and keep my risk low by abiding by all laws. Being that is is online and i intend to operate no physical storefront I assume the law is a little more muddled then simply obtaining a license and not selling to minors....

I intend to build a brand around my originally designed product so that if it is successful i can then branch out to become a retailer of multiple smoking products...

ANY information regarding this particular industry and process is greatly appreciated.

    Be careful, comedian Tommy Chong was sentenced to 9 months in jail and had to forfeit over $100 Grand when the U.S. district attorney ruled that his " Water Pipes," were illegal drug paraphernalia.

    Many states are opening up to such offerings, but the Federal Government is not there yet. Tommy Chong was based in California (A pretty liberal place in regards to accepting the new) and even though the bust was in 2003, you should contact an attorney before you go online with anything that may be considered controversial or illegal. Google Tommy Chong arrested to get leads on related info.

    Yes I am aware of Operation Pipe Dreams. Im also aware of the risks that this site poses, although i am still pursuing my idea... I was hoping not to have to pay a lawyer but the more i read, the more its looking like that is going to be necessary...

      I have looked into this before as well, and own a few domains for this purpose. Never pursued it, as I was a bit worried myself. I do remember there are a few states in the US that it is ILLEGAL to ship any paraphernalia to (Even if it is "just for tobacco"). I believe that is how they busted Tommy Chong - the feds baited him into shipping to an illegal state.

    I'd just contact an attorney and run down the legal and illegal sides. It's a dangerous business.

    Not too worried about it. Tommy Chong is really the only person to have been seriously hit and that was over ten years ago. Many companies are thriving and making a killing.

    Hello, recently I've come across a similar problem and would really appreciate some advice.

    I was searching in the "growing indoors" niche and cannabis kept popping up, but I don't know if it's legal to provide a "how to" website about growing cannabis (i'm in the UK where cannabis is illegal)

    I'd be selling no weed, bongs or anything like that - i might focus on amazon products like grow lights or other general growing related items but nothing about cannabis directly.

    Is this legal to do then? To provide a "how to grow" information about cannabis

      Just keep it general - if anyone asks, its for growing tomatoes.
