questions about Amazon FBA wholeselling and private Labal

guys, newbie here. Been reading about Amazon FBA lately. I got some concerns and hoping someone able to point me to the right direction.

1. Do I need to be an authorized reseller or distributor to resell new branded products that is already listed in amazon? and how about product that not listed in amazon yet?
I checked the Amazon seller app and it does say I'm authorize to sell it new, but that means nothing in this case right?
I'm not talking about big brands like (Nike, Apple,etc). Just small companies with generic products. If this is still require, whats the general process in getting authorized.

2. Do I need a business license to resale products?

3. How can we get amazon to pre-approval my product before me going buying $5000 worth of products. From my understanding, they can reject products base on the following (Too much sellers of this catalog at the time, doesn't meet regulation, )


4. For private labeling when putting our logo into my product, don't we need to register the logo with my business name with business license?(too many sellers in that category, doesn't meet product/consumer regulation, patent issue, etc).. let me know what i missed.

5. According to the amazon website, most products require to meet Consumer Product Safety Act (PSC Mark ), what the process in getting this your private label?

    Your first three questions assumes a business model of buying others' products and trying to sell them on amazon. Some people do this with reasonable success. It can be very hard work because basically it's a price war model where you are always vying against others selling the same product to gain the "buy box".

    Also some people doing this have tried to do it with my brand. They did not have my permission to do so. I've successfully sued two people, up to this point in time. I've lost count of the number that amazon have banned from listing products because of selling other people's brands without permission.

    This is not a black and white situation as there are scenarios where selling other peoples' brands is permissable.

    I make a very significant living selling my own branded products on amazon. I'm part of a large community of others that do the same. Not surprisingly they seek to protect their businesses.

    So, the business model you choose is up to you. I know which one I would choose. It also makes substantially more money and margin too.

      so you telling me every FBA need to be authorized reseller for all brand? I read alot of FBA recently , from amazon website and people blogs.. and not much mentioned on the process on getting authorized to resale a product, but yet here you sounded like is an showstopper, what am i missing here/?

    I am mildly confused by your questions-


    If you are talking about YOUR brand on a product then you should not need to authorized to sell your own brand.


    From my experience there are some brands that Amazon will require that you be approved by the manufacturer to sell. I believe this is a requirement of the manufacturers/company and Amazon is enforcing it. I have only run into this once with an electronic product I wanted to sell.


    For myself getting a business license to resell was a simple process. I just went to the site of the state I live in and applied and got it right away, no fee.

        If the product is branded, has a trademark or copyright or registered design, or patent, you will need approval to resell it.

        Often people will put their own private label on a generic product, but unless you try to sell under that label, you do not need approval.

        You can buy generic products overseas and put your own brand (label) on that product and sell it provided you are not infringing any patent or registered design or copyright.

        In answer to your questions 3 and 4:

        3. Never buy a large amount of product when first starting. Whether buying overseas or locally, buy only a small quantity and list them on Amazon. That will provide you with the answer to question whether Amazon will allow you to sell it. It will also give you some idea about its marketability, but you should have done your market research before buying anything to sell.
        4. You do not have to register a brand or logo. You can do it informally simply by using the TM mark in your advertising and labeling. That gives you the legal right to that brand or logo, and legally prevents others from using it.

          thanks for the answering the questions! but just one more thing. so I need to be authorized reseller to sell all branded stuff? so all retail arbitrage amazon need to be authorized? because I see people buying bunch of branded products from (Walmart,etc) and selling them on FBA amazon, but none mentioned about authorized reseller/distributor.

          Again, am I missing still missing something here?

            If you have legally purchased a branded product from an authorized seller, you have the right to deal with those goods in any way you see fit, and that includes reselling. This is due to the Doctrine of First Sale.

            The First Sale Doctrine protects a buyer’s interest in goods he or she has purchased. Under the doctrine, once the trademark owner has sold its goods, it has exhausted its trademark rights in those goods. Thus, the owner cannot rely on its trademark rights to dictate how or where the buyer uses or redistributes those goods.

            Just make sure the entity you are buying from does have a contract that allows them to sell to you from their geographic location.

        Amazon will tell you when you try to list it in your seller account. You can test this by simply trying to list the item in a dumby listing and delete it after you learn the answer.

          You do not need to get permission to sell existing products on Amazon. The categories that require permission are listed here. You can Private Label a "generic" product with your own labeling and branding without registering your brand with Amazon. All that is needed is for you to enter your own brand name when you are adding the product on your Seller Central page under "Vital Info."
