Email Marketing Regulations - GDPR

I wanted to make sure everyone is aware about the coming Data Privacy regulations - called GDPR, from the European Union. It will affect how you do your email marketing and collect your lists.

A few pointers:
- no more pre-ticked boxes
- a confirmed consent (that you need to keep a record of) for all your records
- big fines: 4% of annual global turnover or €20 Million whichever is greater
- the regulations will come into force May 2018, you have less than a year to prepare
- the right to be forgotten
- will affect everyone who uses data for any entity that currently resides in the EU. You don't have to be in the EU to have to comply to these regulations, it doesn't matter where you are located.

    I understand that is does not matter where we live. But if we only collect emails from USA and our own terms of service and privacy policy states as much then how does the GDPR affect my business model?

    You are correct, it doesn't matter where you live. It won't apply if you are sure that you have no EU data. It means that none of your contacts have changed the location to currently reside in the EU, even if you've initially targeted only the US. So if you don't have EU residents in there, then you're safe.
