A client came to me today for some flyers designs for a MLM company she sells for. So she showed me some samples of what she needed and came across a site that sells graphic designs for a couple of companies. Like postcards and business cards, etc for the distributors (the designs completely suck). The markup was insane and she told me that a woman at the meeting sold 30K flyers this weekend. She did it by buying the flyers and breaking them up in packages of 100 and then selling them for $10-15. Now if you have a good club flyer printer imaging breaking up up an order that way...

Anywho, now I know a couple people that sell it and they told me that they had to sign something that they could create marketing material with the companies name on it or they would be kicked out. So a couple questions I have about this?

1. Has anyone done this before. The site I saw has a few designs to choose from and order preset in quantities.

2. is it illegal to make flyers and marketing designs like this?

3. Is the no name rule only apply to people that work for the company? The people I know that are in one told me that they were forbidden, but I don't work for that company so why couldn't I do this.

4. Devils advocate, if I can't use the company "likeness, logo or or any slogans" which the person I know who sells the stuff actually acted like he had a seisure on the phone about, how its that different from we use iphone, and androids names and pictures, and pc mockups in advertisements?

    I recently started network marketing company, which I guess is MLM, and I asked pretty much this very thing more or less to my upline. I'm by no means an authority, but to answer your questions,

    1. I can't say that I have. Most people starting up may not have a bunch to invest, and will go to vista print, and just have their contact info/website/email on it with maybe an image relating to whatever it is the MLM company does.

    2. If it is going to have the company logo in it, I'm gonna lean toward yes. I have a couple friends who are graphic designers who could've made me banging business cards, but when I asked about the company logo, I was shut down with the quickness. After doing a little more research on the company site, I found that they did have some business cards with a few different designs. Not Cheap by any means, but they looked professionally done. I'd just a soon save up a lil and grab a few packs to start with, and save my graphic designer friends for my IM business cards, :-)



    3. Again, I think trademark and copyright come into play here, but don't take my word for it, definitely do your due dilligence. I wouldn't mess with it though.

    4. Some stuff is public domain, some of it slips through the legality thing by the image being just different enough so you can't be sued.
