Copyright Infringement for product by Squeeze Mobi

I have purchased several products from the Squeeze Mobi group including Insta-portfolio which are mobile templates for various businesses.

I have been contacted by Getty Images that one of the images in that package and posted on one of my websites is being used without license to do so. they want to charge me $800!!!

I wrote to them explaining that I purchased this product and sent the sales receipt etc over and they have just sent me a reply saying that I am still responsible and that I have to prove Squeeze Mobi has a license to use said image!!!

I have wrote to Squeeze Mobi and not gotten any response?

Anyone have any suggestions.

    If that was who you purchased from then I would PM them here in the forum.

    If they don't respond, and it was them that you purchased from then go to the help desk and give them all the details. They won't be able to stop Getty from suing you, but will remove the offer from the WF if it was purchased through the WF.

    Make sure you have removed the offending image from the sites.
    If you want to check an image out, there is always a FireFox browser add on called Tin Eye.

      I got an email like that before from Gettyimages. Like you I didn't knowingly steal the image or infringe on copyright intentionally but I was in the wrong anyway. I just deleted the image from my site straight away and did nothing about it - that was about 2 years ago, I never heard from them again. It's part of their business model and how they make money - I'm sure they send thousands of those emails every day. Some people will pay, most won't. I didn't.

    You don't have any options except to remove the image or pay the $800. They may pursue you legally for the $ and unless you can produce permission from the copyright holder of the image, then you have no leg to stand on.

    Whoever you purchased it off presumably did not have rights to it. You need to be getting a refund of them as well.

      HeH - Well, count me in this group... $480 for my violation.

      Documentation accompanying the Unauthorized Use Notification says in one section that simply removing the image(s) isn't sufficient - Their artists need to get paid.

      Good Luck getting the 'OffShore' SqueezeMobi boys to pay...

      Pretty hacked off about this right now...

      Hope no one else gets tagged this way!

      Off to earn $$$ to pay of these people.

    This is one of the things that I've warned others on before, yet often seen marketers, especially WSO sellers, violate... They create a product that is either a template or website maker or graphic pack where they may have bought the rights to use the images, but they haven't bought the commercial redistribution rights which allows them to let their clients use the images.

    Even outside of images, this applies to other stuff like sound files and such too.

    However, commercial redistribution licenses are not cheap. A $7 license for your own use might be $1k to $3k for commercial redistribution rights in some cases, which is why many people avoid going about it the proper way.

    The alternative is finding images that are free that also allow commercial redistribution (a lot less of these but they are out there).

    Any time you see a seller selling templates, website makers, or anything with images or sound included, you should ask if they have commercial redistribution rights.

    This is mad to think now a days you can get a law suit for everything this is stupid for you ... you should not be getting these issues since you bought something you didn't steal it.

      "Receiving" or buying stolen goods is still a crime in most places.

      Yes, please let the rest of us know which template & image it is. I just picked up their new insta-portfolio base package and have a few of their previous template packages so it would be nice to know.

    Sorry to hear about your problem - it is about to become my problem too when I upload the same package. Pleeeeeaase tell us which image we need to delete from the Squeeze Mobi package. Thank you.

    I made a post over at the Forum Special Offers page : [SqueezeMobi] WP Lead Celebrity - 30% Increase in Results & Instant Local Celebrity Status - Page 2 in reference to this issue and would you believe that they deleted it?

    All I asked was if they were going to give us a license to prove that we actually did receive rights to use the images but by taking my post down I firmly believe that they themselves do not have a legitimate license.

    Needless to say I will never again purchase any product that they offer and I will be deleting those that I did and have not used and will be informing my list subscribers of my actions and why.

    This is something that will eventually hurt the genuine sellers on the WSO forum as everyone will now look at what they are offering with an eye on getting products that cannot be legally used because of image copyright infringement issues.

    To give legal advice. In my opinion You can
    *pay
    *take it down
    *get squeeze mobi to provide proof.



    If you told them when you emailed you bought it, showed your proof then took the image down until further notice, I doubt they will sue you. It will cost more then it's worth and they know you were a victim and you clearly fixed the issue when to some extent you were sent a cease and desist.

    Hope things work out, again I'm not liable for this advice it's just my opinion

      Hello Everyone,

      I contacted SqueezMobi support about the dog.png image in the MobiCashCyclone mobile templates.

      They had a company building the templates, and that company (an indian development team) has since gone dark - No longer responding to emails, skype, calls...

      That indian company apparently didn't catch the copyright on the dog.png.

      SqueezeMobi has updated the template, but you need to check your installations - from what I found every 'images' folder had a copy of the dog.png in it...

      SqueezeMobi said:

      I will be sending them a copy of my Getty Images threat letter for SqueezeMobi to hand off to their attorneys.

      I am *very* pleasantly surprised by this turn of events! I really didn't expect them to step up, and I was wrong, wrong, wrong.

      SqueezeMobi has definitely gone up several pegs on my respect meter... I was sweating this pretty hard, but they will have my Getti Images threat letter this week, and I'll be sleeping like a baby again.

      So - There is your solution for the SqueezeMobi infamous DOG.PNG debacle!
