If he is not incorporated or an LLC then he = COMPANY NAME and he is responsible to refund your money. Sounds like he's a scammer.

At least in the US, a business that has committed fraud owes its debts unless it has legally satsified them. HERE, that would mean, REPAYMENT, Doing the service, or a PROPER bankruptcy.

There's a scam going around and not to many people know about. Alot of foregin people do this scam to get ahead when they come to the United States. Basically what they do is start up a business collect the bread, get credit accounts or whatever and then file for bankruptcy. They get all your money and whatever else they got on their credit account and there's nothing you can do about it.

If any company goes into to business then only a year or so later they're already out of business that's probably what they did.

You dont have to be in the same town, state or even country to file.

The "scammer" would have to petition the courts to have it moved costing him. Or if he didnt and just ignored it, the OP would more than likely get a summary judgement (I thinks it called that.) Then he can do the rest of what I said.
