Hi Guys

This may have been covered before but does anyone know the position of a Affiliate is some one buys through their link and then suffers an illness or injury as a result of using the product?

Any examples would be helpful.

    I am assuming, You promote product X, Customer Y buys and their hair falls out, Does Y sue you, or X.

    Generally speaking, the lawyer will go after the product creator. Mainly because proving harm is more difficult as you are one layer away. Does it mean you can't be sued? Nope, you can still be sued, but it will more likely they will go after the product creator first. Mainly because, one, they proved the harm but two, its highly possible, they don't remember whose link they bought through. As an affiliate, they pass through you to the shopping cart. That is where their card information is through and that is where their T&C's are.

    after all of this, if you are promoting something , there is a rare chance they could go after you but unless you have deep pockets, I don't see the lawyers really going after you.

    I think OnlineStoreHelp is right there more than likely to sue the product creator or seller of the product rather than the affiliate plus it would be very hard to find out who the affiliate of the product is rather than the product seller,owner.

    The best way to avoid being sued is to promote affiliate products which are unlikely to cause any harm or illness to the buyer.

    The product creator is the one who gets in trouble. You did not create it, so it is not your fault.
