Shocking PayPal New Policy Updates

Hi Warriors,

Today PayPal users received new policy updates and I highly recommend reading it at:

What's so disturbing is following part:

“When providing us with content or posting content (in each case for publication, whether on- or off-line) using the Services, you grant the PayPal Group a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable (through multiple tiers) right to exercise any and all copyright, publicity, trademarks, database rights and intellectual property rights you have in the content, in any media known now or in the future. Further, to the fullest extent permitted under applicable law, you waive your moral rights and promise not to assert such rights against the PayPal Group, its sublicensees or assignees. You represent and warrant that none of the following infringe any intellectual property right: your provision of content to us, your posting of content using the Services, and the PayPal Group’s use of such content (including of works derived from it) in connection with the Services.”

So does word "content" in this case mean anything that user owns, for example digital product, eBook, videos or anything like that?

    Well, we don't post content on PayPal so that's not a real issue. What they're referring to is if you write them a review saying, "PayPal is the best company ever!", they can use that review in their advertising campaigns without your permission. And almost every business in the world has the same clause in their agreements.

    This has nothing to do with things you post on other sites though or things that you have a PayPal account linked to. So they won't be stealing your stuff unless it's posted on PayPal.com.

      Thanks for your reply. I sent to PayPal an email about this and I really want to make sure that we users have really understood it properly. I will keep you updated when I get the answers.

      But that doesn't really make any sense, since they are saying that you will grant them all copyrights and even database access, what database access have to do with that? Also how you can post a content on PayPal when it's just a transaction service or am I missing something?

        That's what I'm saying...it does not make any sense at all. Maybe they're talking about their forums and communities? I've never posted there but I guess a lot of people might. Now, also remember that you can affiliate with PayPal and they'll send folks custom offers from you. So for that aspect, I guess you'd have database access to make your ads and stuff like that.

    No! You are not giving PP your ebook, videos or anything like that. Just because you use PP to sell your digital product does not mean they can take over your copyright. Just ignore this legalese.

      OK, guys, I think you are both right, in a sense... but just relax and don't get your day spoilt by a bunch of lawyers!

      Because lawyers (yes, I am sure there was more than one involved here) ALWAYS want to cover ALL their bases and don't want that their client will lose money because of some loophole they left open... so when you read TOSs or TOCs or whatever legal disclaimers, you will always find a lot of redundant expressions and terms that are confusing... and in the end the whole wording just stinks and will look really STUPID!

    LoL, there are so many things wrong with this.
    First off, the number of class actions suits that would follow if paypal was granting themselves the rights to your shit would be staggering.
    Secondly, so because Walmart, Amazon, Best Buy, and every other major retailer online uses Paypal, they are giving Paypal the rights to their content and everything, cmon man, use common sense.
    Lastly, Terms & Conditions NEVER EVER supersede the law, so just saying you are going to own the rights to content, especially copyrighted materials would never ever hold up in court.

    Most of this is standard legal terms that you will find on most major retail websites. Nothing to worry about.

    This is a one of the biggest issue for freelancers, developers and affiliate marketers. So the point is, PayPal wants to run themselves as free entity and not something bound with lots of rules and regulations, which is fair on their part. But by the end of the day, it’s Internet marketer like us which will suffer the most. No you are not use PP by Video, Ebook but remember you can affiliate with Pay Pal and sell digital goods from it.
