My Love Note From A Spammer

I really do like to help people. I'm a firm believer that you get what you want by helping others get what they want first. I'm not sure who talked about that principle. Was it Zig Ziglar?

Anyway, I received an email today that was clearly spam. I knew right away when I saw the subject line. It read "Simple Way to 'Hack' Your Fat Away." Well, I don't subscribe to any weight loss newsletters, so it was easy to spot.

Normally I just delete these type of emails when I get them, but I had a little extra time today so I decided to play along. Sure enough, this person was mass emailing people using a regular email account. What's worse, he didn't even bother to try and hide his identity by using a fake name and a free email account. Nope, he sent it right out from his domain email.

The body of the email was the usual BS. "Buy this weight loss product because it'll burn fat and this and that and you can lose 480 pounds in 16.35 days, etc, etc, etc." Then he went and put Clickbank links that contained his user ID. Didn't even bother to cloak the links.

Like I said, I usually just delete these. I don't even send them to spam most of the time. For some strange reason, I took pity on the guy. Maybe it's because he broke every single rule in the CAN-SPAM Act, or maybe it's because I figured he was just a really green newb who didn't know any better.

I took almost 30 minutes to write him a detailed email warning of the danger of his actions and then I proceeded to try and help him by teaching him a little about permission based email marketing and what autoresponders do and how he could get started with one and stop putting his entire financial future on the line by by mass emailing people from his own domain email account and using his real name and Clickbank ID. I even made sure I came across as someone who was offering help and trying to teach, not as someone who just trying to bash and berate him.

Now, it's not like I did it because I was expecting a reward. I didn't even expect the guy to write back and thank me. I wasn't doing it for any of those reasons. I was doing it because I genuinely wanted to help a fellow marketer get on the right track and maybe start doing business properly.

Well, about 20 minutes later I got an email back from him. I expected he might want to thank me. Instead, this is what I got:

Oh so you can email me with all your f*cking sh*t and i open all your emails and buy from you and now i send you one email by error because you are in my contacts and you don't like it, don't worry i'll make sure i send all your sh*t to the spam folder and unsubscribe from your newsletter and make a nice review about it you f*cking ass face
I guess it's true what they say. No good deed goes unpunished. Your welcome bud.

I saw that. Thanks! Hope you like it. I guess when you do a positive thing something positive usually always comes from it, even if it doesn't happen right away. Good lesson learned.

Absolutely! I agree 100%. It just blows my mind that someone would learn the proper way to do email marketing and then get upset and start raging at the person who was simply trying to help. I guess this guy has the attitude that he could never get into trouble because so many people are spamming. Well, they do go after spammers all the time, it's just not very widely publicized.

    Hee Hee!

Is it something in the air this month, or what.

I had a "marketer" who I unsubbed from. I continued to get emails so I let them know. They assured me I was unsubbed and then sent me five more emails the same afternoon. I let them know I was still getting them and they wrote back telling me if I had a problem I should call Constant Contact.

They are sending me emails after I unsubbed and they think it's my responsibility to call their autoresponder?? I was trying to let the guy know there was a problem before I just reported them for spam.

    A real
    f*cking ass face
    for sure!

I understand how the verse could fit, but I don't thin it's a bad thing to reach out and try and help a marketer when I see that their tactics are just so wrong.

I think I actually wanted to help the guy because when I first started learning about IM I remember I had no idea what I was doing. I actually thought that what this guy did was the way to send email to a lot of people.

I mean, it just made me think back to day one when I knew absolutely NOTHING and thought that an "autoresponder" was a part that went on my car!

So - spam of Biblical proportion?

You are assuming this is someone who doesn't understand - but it's just another person who doesn't care about how things should be done.

He's found a way to send emails for free - and he's going to do it. Eventually, a few people will get mad enough to complain to his hosting provider and they'll shut him down...maybe.

I guess you're right Kay. It's just completely mind blowing that someone would operate this way by choice having the knowledge that what they are doing is not right.

I would think losing his hosting provider would be the least of his worries. I even sent him a copy of the CAN-SPAM Act rules. I was hoping he would pay particular attention to the part that states that there is up to a $16,000 penalty per separate email sent. Guess that didn't sink in, either.

Part of the problem with taking that approach is that the law clearly states that you CAN SPAM, provided you take certain reasonable steps.

Since you tired to be a decent guy and take the high road. Only to have him e-mail you back and call you a "Censor" and threaten to leave you negative reviews. I would just report him to clickbank than hang him on Can-Spam. Some times the must learn the hard way

Agreed. However, he had taken NONE of the steps outlined. His email was just like an email that two friends would send to each other, except for the product promo, of course.

For instance, there was no opt-out/unsubscribe link. No valid postal address. No identification of the message as an ad (although it was obviously an ad, but still it was not identified by the sender as such).

The thing that really gets me thinking about it, though, is this part of the CAN-SPAM Act:

The law makes clear that even if you hire another company to handle your email marketing, you can't contract away your legal responsibility to comply with the law. Both the company whose product is promoted in the message and the company that actually sends the message may be held legally responsible.

That's making me wonder whether or not Clickbank or the actual product vendor could actually be held legally responsible for this person's spam? Probably not, since this guy was obviously not hired to provide email marketing services for Clickbank or the weight loss product vendor.

I hear you but that's just not me. I'm not the type of person who likes to bring negative things on other people, even if they do deserve it. I figure he'll dig his own hole one day if he keeps up his current behavior.

Most of the people who have taken their Marketing to this extent like this spammer are really hopeless.

I would not expect anything less than what he wrote back. Many are just online sociopaths

I hate to believe anybody is hopeless, especially when it comes to Internet Marketing. However, in this case I think you're right. Somebody who would behave like that towards somebody who was genuinely trying to help them definitely has some mental issues.

That's why even though that kind of spamming gets my ire up a bit, I still wouldn't report the guy. I think he must already have lots of problems in his life, especially if he is resulting to such desperate tactics to turn a quick buck online.

Funny thing is, even after he lambasted me, I still considered trying to help him. That's just my nature I guess. The more I think about it, though, the more I realize he may be a hopeless case. That's pretty sad when you think about it. Maybe I'm just naive.

Yeah, not to get too much into the psychology ( or psychiatric) part of things but some people are just really hopeless narcissistic psychopaths.

We talk a lot about this in the Off Topic forum. Some of these people have zero ability to empathize and are just nasty people.

To try to figure them out is pure folly, There is no figuring them out, really.

Something having to do with frontal cortex and amygdala in the brain and suffering from damage in those areas.

You've got some really good insight. I watch a lot of true crime documentaries, and one thing I have learned about a psychopath is that it's not that they don't consider the consequences of their actions. On the contrary. They are very intelligent and normally take every aspect of their behavior into consideration.

The problem with a psychopath is that even though they know what the consequences are, they simply don't care. Not only that, they believe they are superior to everyone and don't think they will ever be caught at anything because they feel they are smarter than everyone else and can outsmart anyone who tries to make them account for their actions.

The potential fine of up to $16000 fine for EACH separate email sent is enough to scare me enough to not even try it, but I guess for someone who thinks they will never be caught and doesn't care about the consequences even if they are caught this is not a problem.

I think free advice is well taken...when it's asked for. In this case it wasn't. I think he just took it as an attack. Maybe when I was talking about some of the penalties that he could face if he continued it he got threatened or something.

I particularly like the part at the end where he says he is going to write a review about me. And say what? That he was spamming me and I offered to help him stay out of trouble and tried to show him not to spam?

I felt like writing back and saying that I was going to write a review about him, too. And while I'm at it maybe I'll forward it to the FTC to see what they have to say about it. I didn't, though.

I find the best course of action in these situations is not to engage the person any longer and just walk away. It is funny, though. I laughed particularly hard when he called me an assface! I haven't heard that one since I was in high school in the early 90's!

That's pretty much what I did, too. I just came and posted it here because I thought it might give other Warriors a laugh since many of them can identify with it. I'm a firm believer in the need to laugh. Sometimes you have to or else you'll cry.

Is it me or are there a whole lot more "unstable" people in IM today than there were 10 years ago?

Come to think of it, I think that pertains to society in general... Scary.
