Contracts with Customers

Hi Warriors,

Hoping you could help me.

My boyfriend *finally* finished his website and has just recently gotten a few customers. He is an audio engineer mixing and producing music for bands.

Despite him gaining customers, we haven't gotten around to figuring out contracts for customers. Does anyone have any advice or guidance on how we can go about creating a legally binding contract to give to potential customers?

My boyfriend I think for the moment is going to accept payment via paypal but this is all too risky IMO.

Is there anything else he needs to consider as well? Maybe a better way for payment?

Most of his clients will be from online advertising and what I like to call his "little following" online.

Maybe directing his customers to his profile on elance, where his clients can pay with escrow? That is supposed to be one of the safest ways of online payments yet.

And as long as he protects his work (Maybe adding his signature audio into the songs), he should do good enough for a while.

Then his clients can listen to his work *With his sound in the middle*, release the payments using escrow, and then he can give them the unbranded, pure audio.

How does that sound?

You may want to try and get in touch with fellow Warrior Bob Silber...

I have personally never used his legal services, but I know individuals who have and said he was top notch...and he knows internet marketing too...

We use contracts called a Statement of Work. This details out what the client is asking for, a detailed description of the services we will provide in order to complete their requirements, all associated costs, a timeline as well as some other legal speak. Both parties sign and date and then work begins. This way you always have something to refer back to when questions arise.

Many DJ's use this technique for their recorded mixes.
Both for branding of their own show, and to protect the original owner of the audio from being pirated.

Hi Keyaziz,

UK law sets out very clearly the requirements that need to be met by a contract for it to be valid. If you plan to work under the UK legal system then use a contract that has been drawn up by a UK lawyer; either use a solicitor or some other service - online or hard copy. Music industry experience would be an advantage.

Payment by Paypal should be OK to start with so long as you abide by their terms and conditions and remove the money from the account promptly. There are better options for larger payments.
