Streaming website, legal?

Hi to all guys!
I'm building my website but in this moment i'm a little scared, i hope that someone with experience can give me some advices...
I'm planning to make my website a "list" of links to streaming shows, anime, films etc... i'm sure you already know what i mean because there are a lot of these websites out there, i know xD but i was thinking... is this legal?
I see that these websites have "DMCA" and stuff like that, where they specify that they just link to a content hosted on another server, nowvideo for example... Stating (and doing) this make the website legal?
Do you know the risks and if it's still a "gray zone" at today?

    Yes, it is legal as long as you embed them on your website and not host the videos on your website. If you are just embeding you are not violating any DMCA. Just like any website that embeds videos. My friends are averagely pulling in ranging from 2k-10k from anime websites. But you need to put in hard work when you first started.

    Anime website is also competitive but it can pull in 100k of traffic per month easily.

      I know it's a lot of work, but i'm worried about the legal part because i read about someone brought to trial for just linking/embeding to megavideo etc, but these are old articles.
      If your friend (and all the sites that are up right now) are ok maybe authorities understood that linking is not like hosting xD i hope at least...

      I cannot fully agree with your words. I could say from my personal expierence. Once I had a website where I was embeding videos and once I get a letter from the copyright holders that I need to pay them some cash for illegaly showing works that are copyrighted. How? For example some of the primary images of these videos were copyrighted and you cannot show them on your site unless you have an official agreement from the copyrightholder and this is no matter if this video hosted on your server or elswhere. I even went to court, but it was cruel... I didin't had thousands of cash at that time, so I've paid a full price.... this was around 600$ dollars

      I know there will be many who wil lsay "this is ridiculous, I wouldn't pay etc.", but believe me, they know how to crush you if they want.

    I read all the responses here but... personally i wouldn't do it. Still seems like a "gray area/zone". It's almost like pirating music.... almost. You think music artists would want a free link to their music from your site, or want CD and MP3 sales that will boost their bottom line?

    Look people do it all the time. Especially on mixtape sites. All i'm saying is that i wouldn't do it. Too much looking over your shoulder and legalities and technicalities.

    You could always just ask the sites you want to link to and see what they have to say. Like Randall says, you are entering a gray area with this. So, all advice here is merely speculation. Go right to the source and ask them

    I see sites where they make statements regarding DMCA that they are just linking to the content and to contact the specific site if there is an issue. I have yet to see a site go down that is doing this.

      Me too, and this is comforting, also if the risk was only a "go down" i would start the site instantly xD
      What scares me are eventual heavy legal issues, but as Randall says it's a gray area, but the fact is that i can't know if who uploaded the content has the right to do it or not, i just find the link on google and post it... Maybe i should contact one of these streaming websites that host the contents as agmccall suggests, but i highly doubt they will answer me

    You have come to the right place. There is nobody more qualified to answer nuanced legal questions than a forum full of struggling internet marketers.

    I've done this before and I know how it runs.

    If you are using a uploading site to host the videos and then embed them on your sites, then you will receive DMCAs from Google to remove those videos.

    But if you are using video hosting websites that has the right to host them, etc, anime shows that's already available on YouTube, Myspace, etc, then you can embed them.

    But you said you are listing think as links. There is nothing illegal about that.

    To start a streaming site you have to put in consideration to follow some technical steps including

    * Never Upload any video's in your own Host
    * Create a DMCA notice in your site with a contact form, telling that you are not hosting any content in your site , you are only grouping links which are available for free online).
    * Choose a good offshore hosting which ignore DMCA message, and make sure to contact the support before purchasing any hosting package.

    * Domain name : make sure not to purchase any county LTD's like .co.uk.fr.es.ro
    * choose a good video hosting who is not going to delet your links and have experience with Dmca .
