Ouch! - HTML/Framer Virus

Have a elance guy from India doing some website work at txrus.com for me. Suddenly, the site went down and this HTML/Framer Virus appeared on my website, and according to the server logs, he is the only one that has logged in and the only one that has uploaded files to my website. He swears, he didn't do it. My question is that if the files are hosted on host gator, is it possible that the virus could attach itself to my folders in any other way than by being uploaded?

Host Gator was great in cs, in that they were able to delete the virus and restore the files to their last backup, but I don't want to falsely accuse the guy if he may be not guilty.

    Tell your guy to FULLY SCAN his computer, it's most likely a virus on his machine that sneaks it's way into their FTP client, and changes all the index.xxxx files, adding the iframe spyware/virus to any site he logs into with his infected machine.

    Had this happen to me a while back, let me go find the thread...
