You talked about "the YouTube niche." YouTube is a video sharing platform or vehicle - not really a niche, per se.

YouTube videos are found in just about every niche imaginable but buyers don't go to YouTube to buy things. They go there to get information which will help them review or learn about products/services in specific niches - then they go to the vendor sites to make their purchases.

IMO, people don't go to YT looking for undiscovered or unpopular video channels - they search for info and videos within their specific niche of interest. For this reason, I think you're going to have a hard time trying to be everything to everyone since you plan to review a wide variety of channels and sell (as an affiliate) most anything.

For this to work, I think you're going to have to focus on a specific niche or marketplace so you can be seen as an "authority" recommendation in that subject. When you try to be everything to everyone, you are so general you appeal to no one.

To be honest, the web site looks "home made." No offense - we all have to begin somewhere. I would suggest using a professional theme in order to give the site a more business-like and trusted appearance.

    (answers to your numbered questions)

    1. No. Just saying where a copyrighted image comes from is not enough unless you have written permission from the copyright holder to do that. You can't just rip off other people's protected images.

    2. The same with using a logo or showing a trademark that someone else owns. These business assets belong to someone else and you should never use them without specific permission.

    3. What is a legal disclaimer? Do you mean an income disclaimer? Not sure what this is referring to.

You can't just "disclaim" all legally protected rights and uses. Typically you would have a "Policies" or "Terms of Use" statement for your web site to protect both your users and your company. The purpose is not to simply absolve you of all potential entanglements.

    Good luck with this venture,

      Hello Ari (wavies)

One of your posts seems to have been deleted, so I'll work off Steve's reply (Hi Steve!)

Legal disclaimers for web sites: Search the 'net for boilerplate disclaimers to cover (1) web site use, and (2) income from affiliate links.

To be honest, there really is no formal affiliate income disclaimer. The law merely states that you need to have one. You can word it however you want, unless you have a huge corporation that likes to pay jumbo fees to its attorneys.

Images: Pixabay offers a ton of 'free for commercial use' images. It's my go-to site.

NEVER, EVER, EVER use anything Getty unless you acquire it through one of their stock image sites like iStockPhoto. A single image cost around $30. Getty is on top of every single photo in their immense gallery, every one of their logos, and any mention of anything that belongs to them. They can be a holy legal terror.

Logos: NEVER, EVER, EVER USE A LOGO unless it comes with your affiliate panel. For instance, in Amazon's affiliate program, their logo is all over everything and you can use it so long as it links in conjunction with your affiliate account number. Otherwise, you're in for a ruinous law suit.

If you use a photo of unknown original source, always check it first with TinEye. It's free and worth its weight in gold. It will not only tell you if the image is copyrighted or not, and if not, you will find out if the image is already over-used.

@steve B, thank you so much for answering. about my website i think that the products that i can affiliate will be products that people need in order to start a channel like a camera , mic and etc. I just strated making websites so its ok for now if its home made, and about the youtube logo i got the logo from pixabay so its suppouse to be uncopyrighted right?

      Ari

Is pixabay a free site for images? if so you may not have the rights to that image so you would need to look at the TOS for the site to see where you stand

Be careful on the advice you are getting on a marketing site , but with regards to the chance they could take the domain is unlikely just in case I would get some legal advice
I would think that they would asked you to remove the image at worst.

You should really look through YT's Terms of Service. They usually spell out what you can do with their logos.

Asking here will get a bunch of different opinions from many people who have not even read the ToS themselves.

If you are embedding YouTube videos on your site and linking to YouTube with the logo then it probably isn't a problem. But I have not searched the ToS for this myself so that is what I would do.

If you are not promoting or linking to YouTube but instead using their logo to promote a "How to be successful on YouTube" course then they would likely have a problem.

ToS are not usually complicated to read although they look all legal and scary. The information you need regarding copyright is usually spelled out pretty clearly.
