Brand Names in Domain Names?

Potentially big trouble.

The Trademark owner is the final arbiter on use of their owned name.

If they wish to prohibit use of the name by others they may legally do so.

Thanks, that's what I figured. I've seen another guy get a letter asking that he turn over the domain but that was it. He was promoting their product but I guess it didn't matter. Oh well, back to researching.

There is a trade mark issue risk involved. If your business becomes bigg enough, the trade mark owner will most likely take some acton to end a violation of its rights

Don't do it! I got into big toruble some years ago, because I had a domain with the word "polo-shirt" in it. I was contacted by a lwayer asking me to take it down immediately. I had no idea that the name polo-shirt might be trademarked.

I busted by Honda for a performance parts site I use to own. Received some nice letters from their attorneys.

They said I could only use the name for news or a non-profit site. I still have the name if anyone wants to buy it. LOL

Yeah, everyone is right about this. I also had the .org version of a well-known UK organisation taken off me a few years ago. The first I heard about it was a notice of court action, so they didn't even contact me to discuss it first. I simply called up their lawyers, which is what they probably expected, and handed it over to them. There's nothing else you can do in these circumstances - the alternative is go to court, lose, and then have to pay the legal costs too.

I am surprised by the 'polo-shirt' name being registered. I thought I would err on the side of caution on this and check with the Intellectual Property Office (UK) at Intellectual Property Office - Trade marks - find by mark text or image
Where do you guys check for possible domain name problems?
I came across it in my searches for micro-niches and found 'febreze air freshener' as a candidate. I think I should stick to product types...

You might not want to do that. I registered 2 domains with ebay in them and was contacted by ebay to not renew the domains or face legal action. I let them go. I simple got new domains and used the word auction for ebay. So in your case you want to go with cameralenses.org. I still see people do it though. I didn't want to mess with the name twitter in my video course in my sig so I simply went with tweeter.

I just looked up Tweeter in the resource I gave above and someone has a new application for this dated 30th July. What happens when this happens in retrospect? I hope that if someone has it before the application then it is safe.

It all makes logical sense - you just gotta' wonder though how come there are so many IM products with the word "Google" in them.

I have a project in development that involves getting strong results from Google & I had my sights set on the perfect name for it - with "Google" in the URL - but I realized it's likely too risky.

Please don't play with branded names, instead of Nikon why don't you try with the camera keyword and find good phrase about it or some short of electronics name so people will understand what is related.

I hope this might help you out...
