Affiliate product sales video is fair use or copyright?

Hi,warriorforum gurus,
I have a question,I saw a lot of affiliate product reviews sites(or youtube affiliate product review channels) usually directly upload the merchant vendors(product producers) sales videos from the merchant vendors'(or product producers') websites.All these uploaded affiliate product sales videos are fair use or copyrighted? In my personal understanding, as affiliate marketers,we have rights to use any promote tools,such as email swipe files,banners,videos on the the merchant vendors(product producers) websites...because we don't own any products and their info copyright,we just help them to sell their products by using their videos,emails,banners...So uploading product sales video to youtube channel or website is fair use, not copyright infringement..Do you think my understanding is right?

    Since it is commercial in nature, it's going to be very hard to make a fair use argument

    Depends on the vendor. They set the guidelines as to how their products can be sold. For instance, some brands won't allow affiliates to market their brands with a negative connotation (classic borderline example would headlining with: Health Product A: Scam or Not?). If discovered, they can (and most likely will) seize sales commissions and disconnect the affiliate from earning a cent from their sales moving forward.

    And there's nothing you can do about it because they've identified it clearly in their affiliate agreement.

    Some brands have 'press kits' which include usable media (recommended or enforced). These usually include videos, banners, graphics, copy and digital assets to help promote their brand in the direction they want.

    End of the day, it's up to the brand as to how they wish to award affiliates based on how it's marketed too.
