This Guy Took My Video I produced and own the the MUSIC Copy Rights and production rights....and slapped it up on YouTube.

I have reported him to YouTube for copyright infringement....started posting all over his sites...NOW he is moderating....I am considering sending Cheney a email...but he is slammed and this really is not his problem except for the fact that he has a THIEF Promoting his product.

I am all for healthy competition. But this is over the top.

Sean, see if you can find this person's contact info. Email him, PM him, do
whatever you can and read him the riot act. Threaten so sue him.

You don't have to follow through but sometimes just the threat is enough
to get him to back down and remove it.

All Youtube members do have member names and I think they have an email
function where you can contact them. I suggest you go straight to the
horses mouth on this.

I agree it's hard to go after everybody who steals your stuff, especially digital downloads, but this is an isolated incident with one person who is easily tracked. So in this case, I say he should most definitely make a case out of it. Otherwise, as Kim has stated above, we're all in for a world of hurt.

The DMCA is the "Digital Millenium Copyright Act" basically it allows hosts to act to remove copyrighted material and avoid potential lawsuits.

The basic process follows this process:

1. You issues a copyright violation with the host with the threat of legal action if they do not act to remove the copyrighted material, provide proof of copyright violation, dates of publishing etc. Give anything that proves your case. You may even have a lawyer approach them rather than your self to give it wieght.

2. They will contact you with any requests for extra information and any copyright violation policies.

3. Once they process this request, they will contact the offending party requesting they remove the material.

4. If they do not remove the content within a specific timeframe they will either disable public access to the page or remove the offending content themselves (in the case of YouTube for example).

They usually move a lot faster for larger know brands (Coca Cola, Nike, etc) as they do have unlimited budgets and massive teams of lawyers. However, the smaller guys have a harder time and have to jump through a few hoops to "Prove" that they have had their intelectual property and copyright violated. So show direct comparisons, quote any trademarks you may possess, show them any sites that may not fall under their jurisdiction to show exactly how they have copied you.

I hope this helps and I wish you all the best for getting this sorted out, people who do this are dispicalble and need to be held to task.

Especially since he can check his traffic/affiliate logs and give you credit for any affiliate sales this person makes as a result of using your video.

I would for sure reach out to Michael and/or whoever he has managing his affiliate program. That's the easiest way to resolution IMO.

Did you "whois" his website to get some contact info? If you are able to get something, you can e-mail him and tell him you know his address, phone, etc, and your threats will sound more real.

I once caught somebody who copied one of my review sites word for word. I got his info through whois, sent him a message telling him his full name, address, and phone and that I will sue. I then contacted the hosting company of his website and let them know. 2 days later the site was gone.

As far as the video, I don't know if youtube will be that responsive as you aren't a giant corporation.

Sean, don't get mad. Just deal with the problem. Contact him, contact his
web host and have him shut down. That's all. Just methodically go about
this. I know it's hard but trust me, I am speaking from experience. If you
don't keep your head and deal with this efficiently you're going to end up
with even more problems.

If you need help with anything, let me know. I have no problems emailing
him in your behalf. I'd assume not disclose the details of what I will say in
this thread as I don't recommend these tactics for those who don't have
the stomach for them.

It looks like a couple of Warrior Sleuths beat me to it but I can offer you some free advice.

One thing that I know to be true about online disputes like this.When it comes to confronting the offender do it by snail mail. Certified letter. In fact spend the $50 bucks to get a lawyer to write it.
People online think they're anonymous and treat their online behavior with an "anything goes attitude".
An email even if it reveals you know his name and address is not as effective as a snail mail letter in his mailbox. The weight of a certified letter is a thousand times more than just another threatening email.

Sean, believe it or not, I agree with this 100% and will be a lot more
effective than what I intend to do.

Send it making sure that it is marked return receipt required, meaning he
has to sign for it. That way you know for a fact that he got it.

Here's how I would go about it...

First, you want to be cool, calm and collected, seeking assistance in the matter.

Call the host & Domain Registrar, and tell them that one of their clients has
just infringed several copyright laws, and has stolen your intellectual property,
and you can prove it, and you require their immediate action.

Tell them that you will gladly provide the ORIGINAL video files that were used
to create the video, tell them how you made the video, how hard you worked
on the video, and how disappointed you are that one of their customers
just blatantly stole your hard work.

Point them to your website, or YouTube link, etc. Then show what this
guy has done as well, and let them decide.

Secondly, ask them if they need to verify that you're the rightful owner,
to contact this person to provide the original source files for the video,
and or ask how they created the video in question.

If he fails to provide undeniable proof that he created that video, which
clearly he can not, you kindly request that they take immediate action in
shutting down this website, because this behavior can not be tolerated, and
if he's done it to you, he's likely done it to others, and will likely do it again,
and they can't risk hosting this website any longer.

Last but not least, point them to this thread, and let them know that you're
documenting their actions, and informing other Internet Marketers on
the actions they have taken, and how they dealt with the situation.

You trust that they will do the right thing here.

Ball is in their court, and you await their response in the matter,
so you can update us on the actions they have taken.

Rinse and repeat with the Domain Registrar.

Hosting companies, and Domain registrars do not tolerate clients
who commit fraudulent activities, and they need to do the right thing,
to protect themselves from these sort of customers, and to protect
others' intellectual property.

I'm sure you've picked up on the whole psychology behind everything listed above.

google his youtube username and see what else comes up. Most people are very lazy and use only one username across the board. You may be able to track him in forums and message boards as well as find other email addresses, websites (from the profiles in the forum boards), ect.

Once you find an email, google it to see if he is using it anywhere else.

Then start to connect the dots....it is very fun and can get quite addictive.

People can take the video and embed it into their site.
Some think that this a copyright infringement....but it is not. As long as the video is not manipulated.

It is no different than someone taking your article from Ezine articles and publishing it...as long as they keep the details...of the author.

And most of the people that do run into copyright infringement are those who use copyrighted material in the Production of their video...ie music, footage etc.

This guy downloaded my video With Music that I purchased the rights too... altered the Video and inserted his information and deleted my Credits at the end. THAT IS A DIRECT VIOLATION.

It would be one thing if he embedded my video on his site without altercation....and Shame on me if I did not include My info within the video...I would have no arguement.

He did remove the Youtube video...but he has about another 7 up and running....and has the nerve to tell me that I could have contacted him first....IS HE FOR REAL?

Now I have not reponded yet. I think that this guy is full of **** and I think that he is fully aware of what he did...And he left out the part where I told him that I am logging all of the video file sharing accounts that he is loading to and that he needs to remove those as well....

What would you respond back with? I am ready to fire off an explosive email...but I am also involved in this first hand. I feel that the approprate thing here is to continue making a stance and pushing harder so guys like this realize that when they mess with fire they will get burnt

I'd work out how much it had cost me, (making sure it was an amount that could be claimed in the county court) and tell him/her/it that you are issuing an invoice to them for that amount. I'd tell them that if they didn't pay X sum within X No. of days I would pursue the matter through the court system. (only works if you are in the same country - so you'll have to find a collegue who is, and name them as your representative)

Usually sh"1"t's them enough not to even think of doing it again, and if you do have a collegue in the same country, you could actually file the papers and the claim, depending on how ~MAD~ you feel.

I've heard that "mate" thing, before. There is a website that posts warez-theft downloads of Warrior products. When I confronted the website administrator about my product posted there, I got that "sorry, mate..." thing, too. And he took the product right down. I know this is common talk in the UK, but I wonder if it's the same guy? I can PM you with the website information; I just PMed a Warrior about it this morning, because his product was posted there.

Now I have not reponded yet. I think that this guy is full of **** and I think that he is fully aware of what he did...And he left out the part where I told him that I am logging all of the video file sharing accounts that he is loading to and that he needs to remove those as well....

What would you respond back with? I am ready to fire off an explosive email...but I am also involved in this first hand. I feel that the approprate thing here is to continue making a stance and pushing harder so guys like this realize that when they mess with fire they will get burnt

(as well as your collegues losing spots)..(I am not opposed to losing ranking if I am out marketed but through cheating and stealing)... as a result of being bumped and lost time to fight a war you did not start?

I have reached out to Michael...and he has been busy today with a webcast and a whole host of other things.
I know he is busy....but I am with you Andrew....and I think this is over the top.

He has bumped me and other respectable marketers out of rankings for a launch that is Paying out $998 a clip.
That is not pocket change...and I stand firm that this is serious.

Yea...he is taking down the videos...but he still knocked me and several others out of position ....HOW MUCH MONEY IS THAT?

This isnt all about money either....ITS ABOUT PRINCIPLE PEOPLE!!!!!

I have been consumed now for over 10 hours....not because I am SUPER PISSED but because I HAD TO. If I did not this guy would still be up and running ....STEALING THE FOOD FROM MY CHILDRENS MOUTH...and any
other Marketer in here who is promoting this campaign or any other for that matter.
