With the new FTC rules being enforced on Dec 1, I wanted to know how many are still planning to use the "As Seen on Google, MSN.." banner on their websites. I would be interested in first hearing how many folks are currently using and if yes, do you have any plans to change it.

Well, I don't know about you, but my sites can really be SEEN on Google's search results, Yahoo's search results, YouTube's search results and even EzineArticles and some other sites mentioned my sites. So, why can we use "As seen on". It's not like "Google endorses....bla bla bla" |

I think Adeel's using that "As seen on". I don't see a problem with that. If you have one article on ezine and one link in google and msn and your site is on clickbank you can say "As seen on" ezine articles, google, msn and clickbank. Mike |

My impression was the same. But I didn't know if that would constitute deceptive advertising or something that would get you in trouble under the new FTC regulations.

As long as you're saying "as seen on" and not "endorsed by" I think you're in the clear.

My guess is that the FTC will have far bigger fish to fry than this, and not be too interested. I do think it's basically "deceptive marketing", though. In my opinion, the purpose of doing it is to try to lend the product an air of authority, authenticity and credibility to which it's not really entitled in quite the way that it's presented. I also suspect that more people "see through it" than many marketers imagine, and that that does them a disservice, simply raising questions about their own integrity in the minds of their potential customers - in other words, it has a very real potential downside, too. I've never sold my own product(s), but I won't be using "techniques" like this in future, anyway, and I think marketers who do are making a mistake, to be honest. |

I've always thought "as seen on" was rather deceptive the way it's being used by many people in the IM world and additionally, the use of those companies' trademarked logos in conjunction with a commercial product is just asking for legal trouble. A lot of people operate on the "everyone else is doing it" assumption which does not protect you from lawsuits. |
