The forums are probably the worse place to seek answers for these type of questions. Since everyone is an "expert".

Of course. This is true of most federal laws and regulations and has resulted in a situation where the average US citizen is guilty of committing at least 3 federal felonies on a daily basis. Government prosecutors can pick and chose who they wish to persecute for 'crimes'
