Default The End of ClickBank 'Proof' - Time to Review Your Sales Pages

I'm sure we have all seen the new ClickBank TOS by now, but here's something I have not seen anyone else speak about so far ...

CLICKBANK'S IP RIGHTS.

... Promotional use of images or reproductions of Payment checks issued by ClickBank without the express, written consent of ClickBank is prohibited.

So that should mean the end of Sales Pages showing the old ClickBank 'proof' of sales. It should result in quite a shake-up.

Will

I thought that was in the previous version. I didn't think that was new.

I dont see what the big deal is. Get permission from CB and show all the proof you want.

All this does is help stop people from faking or skewing their results.

I would be more concerned about the FTC and showing proof thats not typical of what the customer can expect by using the product.

So Clickbank TOS 6.a..

You shall not use ClickBank's name, trademarks, service marks or any other IP Right of ClickBank in any manner whatsoever to suggest association or affiliation with or endorsement by ClickBank without the express prior written consent of ClickBank, which ClickBank may withhold at its sole discretion. Promotional use of images or reproductions of Payment checks issued by ClickBank without the express, written consent of ClickBank is prohibited. For the avoidance of doubt, the foregoing prohibition applies to any use of the Vendor Spotlight.

I'm sure vendors can't get their sites approved if their domain name has the word "Clickbank" on it. I haven't seen a product on Clickbank that is approved. Most vendors use short forms like cbpi**** cbco***

I suppose one can always ask for clearance by writing an email to Clickbank seeking for permission to use it for promotional purposes as long as it does not negatively affect Clickbank in anyway.

Interesting legal stuff.

I have a few Clickbank websites with my Clickbank Screen shots on them. I remember when I submitted it for Clickbank approval they immediately wanted to know what account name it was and what pay period. They double checked it and OK'd it. I wonder If I'll have to remove them or add some new disclaimer.

That was always in their terms. I remember reading them quite a while back and thinking that they didn't inforce that particular part of the TOS at all.

So I would assume nothing has changed.

Thanks for the heads up. I quit caring about Clickbank some time ago and do not actively promote anything through them any longer.

Surely enforced truth in advertising can only be a good thing. All it will do is drive away the cheats and make for a more level playing field. The honest advertisers will benefit.

Any product that shows a "check" as proof is immediately disqualified from my "credible" list.

If you cannot show a check then you show a direct deposit
in your bank account. This should work just as good.

Income proof still works to boost conversions so it would
be used in some form or the other. (I guess that's why
some marketers make them up.)

Sounds to me like ClickBank just doesn't want people using their images for their own gains - if they are not using the typical images like buy buttons that ClickBank provides. The site has several other images as well that I've seen people use, which I'm sure breaks this rule.

It's good that ClickBank wants you to request specific approval - it means that they will make sure the replicated cheque or account sales list people use is valid and not fake.

Yes - interesting stuff. I personally think if it stops the practice of faking earnings then it is definitely a good thing.

You know...it's always been this way...I always laugh at people who email me to say our screenshots are "Faked" with re: to earnings for our clickbank products. It's not possible (well...it may be possible for short periods of time...if you get it approved, then change it...but they even spot check sites...we've been reviewed after the fact)

Clickbank is one of the few good guys out there...IMO....they always verify every earnings screenshot we want to use on our sales pages.

I think that's a good thing...have no problem with it.

Technically, if you were to follow all of Clickbanks TOS to the letter, you probably couldn't even post here about their new agreement.

13.f

Quote:
Publicity. You shall not issue or make any publicity release (including press releases and advertising or solicitation materials) or other public statement: (i) relating to this Agreement; (ii) using ClickBank's name or referencing the ClickBank Services; or (iii) suggesting or implying any endorsement by ClickBank of You and/or any Products without the prior written approval of ClickBank, which ClickBank may withhold at its sole discretion.
Guess, I just broke that one myself.
