Anyone here been sued?

Well? Just curious how many warriors have run into this problem and was it the result of anything major? Or otherwise pretty small stuff? Curious to hear...

    I have had more lawyers letters in my years than I can count. I am being sued at the moment but I can't say by whom.

    Last year I spent $40k on lawyers.

    my lawyer is one of my best assets, many have tried, all have failed.

    I spent close to 7k this past year on lawyers, I think it's just part of business with so many sue happy people out there.

      Can either one of you comment on the severity of the law suit? I'm curious what it takes for someone to go sue another person, what's the threshold?

        You can almost sue anyone for anything. The real question is, what attorney will take the case. Attorney's do not take a case because you can sue. They take them based upon what the RETURN will be. Kind of like affiliate marketing. They look at the CAUSE OF ACTION and how likely they are to prevail. If the cause of action is low, they will probably pass on it. If the cause of action holds a lot of water and their is a DEEP pocket or insurance company that they can add to the caption page and hold on past "summary judgment" then, look out your going to be spending a lot in defense of what you might have done. Not that you did it or violated it, but that, you somehow got connected with it.

      I've had several threats but only 1 went through it. I was sued earlier in the year but the idiots didn't even bother to show up for court.

    We were sued over a horse deal when we were in that business. We won the case, but all three parties lost financially. The only ones who made out were the attorneys. The people who sued really lost their asses in attorney fees and court costs.

      I'm aware that I was listed in a lawsuit, but I've been moving so much no one could serve me papers. LOL, just keep moving and you can avoid it.

      It's my understanding should I ever see papers, it will be thrown out for lack of jurisdiction anyway.

          Absolutely serious.

          A group of us were suing someone on line in a class action lawsuit, and there was a retaliation where a select few were listed in a counter suit.

          Some fellow activists did get served.

          Back at the ranch, my name is swimming around the web somewhere on some legal documents.

          I have a laywer in place should the occasion arise, but the others served all had their suits thrown out for lack of jurisdiction.

            I got one threat because I used a company name in Adwords.

            My husband got sent books and books of paperwork from lawyers for having a domain name with a trademarked term (I don't even think he realized it was trademarked when he got it), so he just transferred over the domain name.

            They could have just asked nicely, but I guess lawyers need to eat too :-)

    Usually they hope threats will get you to stop what you're doing, and that's all they want. They really have to have a strong case if they are going to win.

    I was sued early in our Internet business for selling electronic items from a supplier whose logo had allegedly infringed that of a multi-national. Of couse, we did not know about this dispute when we started. But I was sure it was all nonsense because the two logos were so dissimilar. Anyway, we did not make any reply to that. As the suit was bought in the U.S. we could ignore it because we were in Hong Kong. We even refused to take delivery of the formal court documents (same tactic used as Avenuegirl, this is a hint!)

    In the end, they started going after our hosting companies who started to shut down our sites. We had to switch our hosting back to Hong Kong and our webhoster promptly received an attorney's letter that was not threatening. What upsetted us was that they asked our webhosted not to tell us of the existence and the contents of that letter. In the end, we decided that it was not our fight and the same supplier simply gave us another brand.

    Over the years, I had received lots of attorney and C&D letters as well. But all came to nothing and we never spent a single penny on lawyer fees. I really feel sorry for those who live in the U.S. because it is just one of the most upsetting experience and threat that a business could have.
