How to sue scam site? Any suggestions?

I have found a site that is illegaly selling my product and wso!

Site is d---------l.com

I contacted his owner to remove my product, but no response!!

Can I sue it?

If Yes, please tell me process.

Btw, server is in China...

    idk about sueing but you have definatly done most of what you can do. I guess you could contact a lawyer and ask but still i think it would cost alot of money to do that.

    Unless the owner of the site is U.S. based, your chances are slim and none, and Slim just left town!

    Either way, you'd better have some VERY deep pockets, because it will cost you an arm and a leg to file a lawsuit.

    I have an account at the digital point forums that has been used for just a few posts and I've received PMs promoting that site and other stolen work.

    My guess is they're outside the US.

      You're going to have to do some serious digging to confirm this.

      Other avenues of attack (to get them shut down):

      1. Domain name
      2. Merchant account
      3. Autoresponder service

      You can file complaints with each, and see what gets shut off.

    Get together with all the other people they're ripping off (big names too) and see if you can devise a plan of action. This site is outright stealing their material and selling bootleg.

      Had a similar experience with a site that ripped off some of my stuff and was selling.

      I emailed them, FA response.

      Tried calling them - ditto the response

      Finally sent them a fax with all kinds of CC's in it including:

      FBI
      CIA
      Central Bank of their country
      My Central Bank

      None of which I actually sent

      They took my stuff off their site immediately.

      The moral is "if you reference friends, make them big and bad"

      Worked though...

    He lives in China. Sorry but you are 99% chance of being out of luck. Unless you have an International Copyright on your product. Even then its still pretty much impossible to win this case just because the nature of the international copyright laws and how they are governed.

          If the server really is in China, and you figure out how to keep them from pirating your stuff, contact any movie studio or production company in Hollywood. You'll be a very wealthy person before the day is over...

          Otherwise, all you can do is play defense with one hand and try to stay in front of them with the other.

    I think there has been several threads similar to this - and the legal action seems a nightmare and probably impractical. But maybe the hosting company or domain registrar may help.
