My Site Ripped Off - What Do I Do?

While checking the rankings of one of my sites I noticed that the site above me in the SERP has basically ripped my site off!

Same wordpress theme, and he stole my front page text almost to the letter.

What recourse do I have? His site is hosted thru Godaddy. If I send them an email will they do anything?

    Wow, sorry to hear that. I guess you can start by sending GoDaddy an email. Since your site was first you can always accuse them of copyright infringement, but that is such a long tedious process, involving lots of legal issues and can cost you money. I guess you can try to play your cards by advising godaddy that you might take drastic measures if they do not do something about it. BUT sadly, I do not know if there is very much to do here.. GOOD LUCK

    GoDaddy has been abused around these parts in the past, but if you call their support number, you can usually get a human that is fairly competent quickly.

    They may not tell you what you want to hear, but you could at least get perhaps get an answer and find out options via them without waiting for an email response.

    If you go to their home page and in the top right change/set your county, the support number will show there.

    Hope you can get somewhere!

    Hello,

    Sorry to hear about the problem you've had. I have been building large content sites for years and have run into this before, of which you have a perfectly acceptable recourse of action.

    First, you are required to notify the site that you take exception to their using of copyrighted material. Do the following:

    --> Create a copyright infringement notice. Use the following text:

    Code:
    (The URL that is copying you)
    
    The material in the manner complained of is not authorized by the copyright owner, its agents, or the law.  Please remove it immediately.  I am the copyright owner.  I do not authorize this blatent copy of my website to be on your website nor do I authorize any usage of the copyrighted writings listed on my website (link your website).
    
    I state that the information in the notice is accurate, under penalty of perjury.
    
    (Your name)
    
    (Your mailing address / PO Box)
    --> Do a whois on their domain and email all listed contacts. Note: If it is using a private domain service of Godaddy, visit that website and submit a copyright infringement notice.

    --> Contact the hosting company and submit to them the copyright infringement notice.

    --> Do a whois on the hosting companies IP address of the website and submit a copyright infringement notice to their ISP bandwidth/network provider.

    --> 5 days after you submit the notices, call every phone number you can find related to the: Domain owner, domain host, web server host, ISP bandwidth/network provider. In your phone call state clearly that you have submitted copyright infringement notices and that it has not been heeded. Call from a phone you own that you can obtain phone record proof from your phone provider of the actual phone call including the date and time. You will need these records.

    --> After another 5 days, estimate your damages, then file a lawsuit in your local district and name the domain owner as the defendant. After your lawsuit is filed, get a court order to reveal the actual owner of the domain and submit this order to Godaddy and the hosting provider.

    Once you have that information, follow through with the lawsuit. If they live in the United States then it is much easier to have a financial settlement. If they are not in the US, then you will at least be able to bring the website offline and possible gain ownership of the domain.

  • A friend of mine has had similar problems. He too, had to contact GoDaddy. Unfortunately, as someone else said here, the response he received was not very pleasant. Maybe you will have better luck!!!

    There may be an easier way, simply file a DMCA notice with GoDaddy, it has worked quickly for me on three out of four occasions.

    2. For Copyright Claims, upon receipt of appropriate notification from the Complaining Party, pursuant to Section 1 of Copyright Claims above, Go Daddy will remove or disable access to the material that is claimed to be infringing.
    3. If the Complaining Party provides Go Daddy with appropriate notification, pursuant to Section 1 of Copyright Claims above, including information reasonably sufficient to permit Go Daddy to locate and remove or disable the material in question, or includes information concerning repeat infringement, then Go Daddy will forward the Complaining Party's written notification to such alleged Infringer and shall take reasonable steps promptly to notify the Infringer that it has removed or disabled access to the material.

    The email address of the website owner, who has reprinted our content illegally, is alex@copypaste.com.
    I have a good faith belief that use of the copyrighted materials described above as allegedly infringing is not authorized by the copyright owner, its agent, or the law.
    I swear, under penalty of perjury, that the information in the notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

      I have those skills but would never do something like that. It is one thing to rip somebodies content and be pursued in a civil lawsuit. It is another thing to break federal laws and subject yourself to 20+ years in jail.

      Your best bet is to always be honest and clean and respectable.

    About 4th post down on domainingdiva.com there's a post I did on exactly what to do, a sample DMCA notice for you to use, etc. Works for me every time.
