Are Other Websites Allowed To Take Your Banners?

If you have a banner or graphic that you created, are other websites allowed to use it without permission if they make some very minor changes (ex the colors)?

Are there any ways to prevent this type of behavior or go after the web owners who do it?

    No. No one has the right to use your graphics without your express permission.

    The best way to handle this is once you create your graphics bundle everything up and file a legal copyright with the government. Then you can legally prove you own the graphics and have legal standing to work with.

    You can file a DMCA and contact their hosting company for
    copyright infringement by their customer. If you contact the
    customer directly, they'll probably ignore you.

    I am not sure what the exact procedure is for enforcing a DMCA.
    There was a thread on the first page earlier today on that subject.
    Also, WF member SBuccariel (spelling?) has a post on one of her
    blogs detailing how she did this against someone. She lays it all
    out with links, what to do, etc.

    Might want to check it out.

  • Happens all the time. Unethical. But if you don't have the time and money to go after them then you lose.

    I've had several of my graphics lifted and used by another affiliate.

    I wrote the program manager of the affilaite program and they didn't care at all. So I stopped promoting them.

    The Net is full of useless plagiarists that don't have the talent to do anything but copy other peoples work and then pretend like they are doing something special.

    What about if you are promoting a product but the product owner doesn't have any banners to use for advertising. Can you use the banner or images from their sales page to use as a banner on your own site to promote their product?

      Only if you get the site owners permission before hand. Some site owners couldn't care less but some do not want you to use their work on your site. Bottom line is that unless you have been given express permission then you are not allowed to use it.
