I want to make a site, where people visit it, enter their paypal, name and email, and at the end of the day a random winner will be chosen and given liek $100, or $20, $50 and etc... always different... is this illegal in the US?

    My guess would be that it's not legal -- you'd essentially be running a lottery.

    I think you need a specific license & all sorts of accounting & reporting procedures to run a lottery (which is what this is)

      Are they paying for a chance to win or are they being entered into a free drawing?

      There's a difference between the two. From a legal standpoint, it'll be easier to do a drawing than a lottery. Also, be aware that state and local laws may regulate what you can and cannot do in these situations as well. Some places, for example, do not allow games of chance and require a skill test of some sort whereas other areas do not have that restriction.

      As others have suggested, you should discuss this with a lawyer, but I would recommend that you speak with a local lawyer who will be familiar with your jurisdiction.

    No.. they are not paying for a chance... I cannot discuss this with a lawyer because I don't know any lawyer from the US....

    Will it still be illegal if I give out gadgets instea of money? But plz remember they dont have to pay even a single cent!

      Well we aren't lawyers here and you need to find a lawyer here in the US. Do a Google search for internet attorneys or something in the US

    I would stay away from this idea, you could get into all sorts of legal trouble, especially as you would effecitvely be running a lottery which you need permission to do anyway, there are far simpler ways of making money out there.

    That depends on how it is set up, what country you live in, the laws that govern that country, laws on the net, etc ... If it is set up like a lottery or "take a chance" type of thing, then Dan is correct, you need a specific license.

    If it were me, I would contact a lawyer and get their opinion on how to set something like this up, what legalities are involved, etc ... before attempting to go live with the site. It's just safer that way.

    You wouldn't want the Government to be all over you would you?

      No one is going to be able to give you an entirely accurate answer. Most of us are not lawyers. And, we don't know where you are or your local laws and regulations. Additionally, we don't know the full details of your plans. We know that it's something akin to a drawing as opposed to a lottery, but there are regulations that cover drawings too. And, is it a simple drawing, or is your system more complex, involving something like signing up for offers and surveys and the like?

      That's why you really need to get a hold of a lawyer. If you want an accurate answer, that's the only way you're going to get one. Those of us here who are not lawyers can tell you stuff to the best of our ability, but we can only provide answers based on what we know. And, not being lawyers, we don't know what we may need to know thus we may not know to ask of you the right questions to give you better answers. A lawyer will know what questions to ask you so as to give you more accurate advice.

    Will everyone please STOP with the lottery nonsense....

    If it's FREE... as in NO PURCHASE REQUIRED... it's not
    a lottery as that term is defined by law in every U.S. state.

    You can give away all the FREE stuff you want... but it has
    to be FREE... NO strings attached... NO purchase required.

    Many U.S. companies do it every day.

    Do they need to give you their PayPal address so you can add them to a mailing list, and you know that a PayPal address is going to be legitimate and checked more often?

    In other words, what's in it for YOU?

    What do you get out of it?

    There's obviously somethnig you're not telling us. After all, you must be giving that much money away every day for a reason, yes?

    Answering those questions will help us give you a better answer, too.
