I have a job in medical sales. We have an inside sales team that get leads inquiring regarding our product. Some of these are accurate and some of these leads are not. But they come from a variety of places (marketing companies) We are talking leads that go back 3 or 4 years ago.

I am no longer able to view the company's marketing section but I saw they paid an average of $20 per lead. I also saw on our companies website, they are looking for affilaites to promote their products and to leave a name and number and an account manager will call me.

Ok, here is the deal, do you think I could get set up as an affiliate? I would get an LLC and be known by them as a company so checks would go to the particular company. I have access to all the leads going back years. Also, when I talk to a new prospect, I could direct that prospect to my website to sign up.

I wonder if they would pay me on a lead even if it did not close, thay advertise on the site as if they do, but I don't trust them.

I was looking at one of the problems as how would I get around if they already paid a commission on a past lead and now this lead comes again? I could also go get all the leads that at the time did not qualify or we could not work with their insurance and put their names into my site.

I know I have given a broad stroke of this, but you guys with experience on affiliate marketing and such, would or could this work and what holes need to be filled in?

    hmm - it sounds to me as if you are on thin ice. I would go to their affiliate page and scrutinise the Terms and Conditions first of all. I'd also see if they are part of a bigger affiliate network by checking out places like Offer Vault and again do the same. But i guess the only person really qualified to give a full opinion is a lawyer?

      I may be misinterpreting what you are saying.

      If I understand correctly you are talking about using for your own purposes leads that your company has paid for and that you have had access to in your capacity as an employee/contractor.

      If that's the case, those are not YOUR leads and this could (just my opinion, IANAL) be a breach of company confidentiality. Affiliate marketing is about generating your own leads and making sales - not about using someone else's leads for your own gain.

      I can't imagine your company would be too happy about that.

      If you feel there is untapped potential in the list, why not talk to your company about running a campaign on their behalf and negotiating an appropriate percentage.

        If that's the case then for the love of God of man.....think first very carefully on the things that you are about to do..... just a suggestion though.....

    Could you clarify if you're talking about selling the leads acquired by your current medical sales employer to another company?
