Does anyone really care about getting legals for websites right?

I know that legal compliance is a need, not a want and therefore down the list of considerations when people are setting up their websites.

Just wondering what the main legal issues are for people, and when they come up. It seems to me that most people copy and paste terms and conditions etc from other sites and cross their fingers.

What's your experience?

What are the main questions about legal issues that you have come across, and when do they come up?

Are there any legal topics relevant to your online business that you wish you knew more about? Like what?

copyright? terms and conditions? disclaimers? spam compliance?

    I always pay the attorney a couple hundred to write one for each of our sites when we build them. But long before that day, when I had no money I copied and pasted them (Not recommended). In any event if your going to ask that your going to need to look at carrying E&O insurance as well. In the end ask yourself this; What is the chance that I will get sued, and is my website really covered by a corporate veil.

    If you think the chance is high your probably doing something you should not being doing, but if your doing something like we do with licensing content, you should get an attorney so all the bases are covered, on the other hand something like a blog you would not have to much to worry about unless you make false claims or something like that.

      I probably could have phrased the question better.

      I am an attorney. Wondering why some people, like you, automatically get their attorney to put together T&Cs etc, and why others don't bother.

      At what point do people say "Oh, better get my lawyer to do that?"

        Generally the only thing I really care about is avoiding trademark infringement. I don't want to build a site only to have someone come along 5 years later to claim it as theirs. I go to great pains to research my domains and get some kind of agreement if necessary.

        That is easy.. Operation income and personal net worth growth. At some point I started doing it because I was worried that my ripped TOS/PP would not cover me if I was sued and I wanted something that covered me for whatever crazy event that could ever happen.

        Today I still use them, but I'm two cent wiser now and know the price it takes to go to court so I know when to rip my own TOS/PP or hire you all to write a new one.

        In my experience, there are three things that must be true before I get a lawyer to do something.

        1. I think it is likely that I may get in some legal trouble.

        2. I have a lawyer readily available in the first place.

        3. I have several hundred dollars I don't need.

        In general, question #1 is the blocker, and if I go "I could get in legal trouble with this particular business enterprise" it's usually more cost-effective to throw that plan away and do something else.

          Absolutely! It's not worth taking the risk.

          Also when considering the Internet you have potential jurisdiction problems. If you are US based you would presumably use a US lawyer but that might not protect you from a UK suit and vice versa.

        Goes back to the old aspirin versus vitamin thing. We wont prevent a headache but when we get one we sure do need that aspirin NOW!

        I come from a legal background and the only issues I have run into are copyright enforcement, compliance, and the BIG ONE is partnerships or JV contracts.

    I think its important to have these laws and regulations applying for websites.. There have to be more consequences in world wide web. I also think one of the biggest challenge is to work online avoiding copyright and trademark.

    I have the forms by Kindsvater and I'm going to buy his latest WSO soon. I think of him as my WF lawyer (he probably doesn't like that ) It has a lot more legal info in it.
