CAN-SPAM law question...

If visitors OPT-IN to my blog updates and receive notifications of new posts via an email newsletter, does this fall under CAN-SPAM laws???

    Hi,

    I'm not an attorney, and you can research the Can-Spam law for
    details.

    But if people are opting-in to receive emails from you, then it will
    fall under the CS law. There are two recognized types of emails,
    commercial and transactional or relationship type emails.

    Commercial involves advertising/promoting a product or service. The
    second is to "facilitate, complete, or confirm" a previously agreed-upon
    commercial transaction, so it's transactional or relationship.

    I don't know how the matter of receiving updates is viewed in a legal
    sense. But it does seem to me that since people are opting-in to
    receive email from your business, if it is a business, then you need to
    adhere to any privacy laws and the CS act.

    You would also need to include a clear path for unsubscribing from your
    list.

    But when in doubt, just look up the law and read it.

    Thanks for the response...

    I see many blogs who send emails saying "New Post" who don't put an address or an unsubscribe link so I was confused.

    Maybe they are just not following the law.
