Help: The Can-Spam Act

Hi,

The "can-spam act" - Does it affect people from different countries than the US?

Can it affect me if I'm sending emails to my list from a free webmail address?

Say I want to address American consumers and appear as an American citizen but I'm not from the US, can I use some bogus US address in my emails as my company's address without having problems with the "can-spam act"?

Thanks.

I believe it applies to the entity sending the e-Mail. In this case I'll assume you're using AWeber, but any of the other big autoresponder services will be the same. They are located in the US, therefore all users of their service are subject to US laws and US jurisdiction.

EDIT: IANAL (I am not a lawyer.)

If your users opted for your newsletter it is best to be honest and state where you are located. Stating your location is required regardless of where you are, the CAN-SPAM law applies to all Internet users.

My experience (11+ years) shows that using a non- USA location wont reduce your newsletter impact.
