Using brand names as theme keywords

Doing some research with market samurai I have found a keyword phrase with great potential traffic. It is about women's clothing line created by a celebrity woman. Official (I guess) website ranks 1st, but I could relatively easily take that position. edit: It's not official I guess, because it sells eBay items.

I would use that phrase for a domain to get traffic and promote offers from AdSense, Ebay, etc, as I have seen this model working for some people.

It goes like "x clothing", where x is not the person's name but a brand name. And that name can mean more things.

Are there any possible consequences? Like receiving cases and desist letter. And is there some solution to it?

    You could be skating on thin ice here.

    Most of the members of the Warrior Forum are not lawyers, some like me have studied and been involved with law for many years, but do not give advice to a post such as yours.

    I recommend that you consult a qualified legal representative in your geographical area, who understands both the Internet and international law.

    5ky, I wouldn' t touch it with a 10 foot pole....I've heard the horror stories of people who had sites established for many years only to lose it all since they received "the letter" from the company's attorney.

    As far as a way around it.....Hmmm......Find a good attorney! Just make sure that the potential from this opportunity will more than pay for his legal fees!

      I received an official letter from the legal dept in conjunction with my first domain name...

      I was told to Cease And Desist... In no uncertain terms, I was told to take down the domain or face a potential trademark infringement case in court...

      I renamed my website and purchased a new domain...

    My advice is to use a different domain name and go for it anyway. It is doable if you use a good article submission service.

    See this example. My domain is generic in this case.

    Domains do help, but you aren't competing against anyone using the perfect domain.

      Use the brand name as a folder on your main site. There is simply no point in taking the chance on getting served with C&D on a domain that is making money for you.

    Personal opinion only, no relationship to being a lawyer, etc.

    One possibility to consider is using a subdomain name. for example, wonderful.stuffforsale.com. Where wonderful is your tm name. I understand that Google likes subdomain names almost as much as the standard domain names. Chances are, you can modify it less painlessly than losing the .com domain name.

    Just a thought.

    Just like the others said here your trending on thin waters. Going after trade mark in the domain name. There's a lot of different options you could do that will keep you safe.

    I have had a few friends that there whole sites were taken down.

    If you use a trademark in your domain name, your subfolder or your subdomain or your bathtub, you can get into legal trouble.

    Yes, you may get away with it for a while...

    And you might make a fortune in the mean time...

    You might also get smacked with a major lawsuit the day after you put up content, before you make a dime.

    It's a risk. If you wish to take it, that's your business.

    Consider it carefully, especially if you can avoid blatant use of a trademarked/copyrighted term and still rank...

      It is also possible to get a cease and desist for a subdomain, a folder or even a page title.

      It's not worth the potential hassle to me.

    This may or may not help I am not sure but I have used Model numbers in domains as opposed to brand names - mostly in electronics.

    If there is something in the fashion world that gets known by its model number then using this as a domain name is powerful for SEO.

    Thanks guys! I appreciate your answers. Seems like it's more a gamble than a business opportunity.

    I still see some sites that are playing with matches here and they are still on, but it's really not the kind of game I'm looking for.
