Is this possible... Sell Keywords / Method

Can you sell to someone an "Exclusive" proven method with Keywords/PPC to someone?
Meaning if you sell them a proven method of keywords for a ppc campaign, Exclusively (meaning nobody else can do this method).

And the person who sells the exclusive method ends up using the method again, can they get into trouble?

Example would be, This person has a method of keywords for a ppc campaign for a particular niche, and this person sells the exclusive method to another person, but this person continues to use the same method, what is this? Is it legally wrong?

  • I might have misunderstood your post, but I will give it a shot anyways...

    For something like PPC, I don't think there is such thing as an exclusive method. Sure, there could be exclusive information on how to carry out the method (like directions, etc) and you may get in trouble for reselling that if you don't have permission, but it really doesn't apply to the specific method (actually carrying out the process).

    That didn't really make much sense, but I tried...Maybe some more details would help?

    Thanks, yeah I think you may got it.
    Basically a specific directions like go here, bid this price etc...
    Like a step by step.
    But this is not an ebook, or some sort of product, just information.

    Basically can you copyright a method, a procedure, step-by-step process?

    Wow, making it complicated. Let's see if we can draw a parallel...

    It would be like someone that sells the idea to advertise a book by using the authors name as a keyword.
    Now he has come up with this 'original' idea and sells exclusive rights to the method to someone else.
    You are saying will he get into trouble if he continues to use his idea after he has sold the exclusive rights to it.

    Ok, let me have a go at this.
    1. Does he have the system copyrighted?
    2. Is there anyway of telling who is using the same system?
    3. Is their an exclusivity contract signed?

    Going backwards here if number 3 is not in place then he can do what he wants and there is no recourse.
    With number 2 what I am getting at is how do you know others are not using the same method?
    Finally number 1, does the person even have the right to sell the idea? In reality anyone can sell anything provided it is not stolen from someone else. So probably the least relevant.

    There is no such thing in my opinion. The only time something like this can work, is if the keywords are trademarked or something. I could be wrong but no such exclusivity exists other than trademarks.

    I believe you can copyright a way to do produce something. For instance, how to make Luciano's Cappucino using method 'A'. However, I don't think you want to spend a lot of money and time sueing someone if he does not have a lot of money :-)

    Not sure if I have understood you fully but will have a go. Ideas cannot be copyrighted, only content (all sorts of different types of content) so in that respect if you create a system, and then sell it to someone else to use then the actual way you have conveyed the information would be covered by copyright but your idea itself would not be. That is why there was a rash of Harry Potter clones on the market a year after the author made it ia hit.

    Thanks everyone.
    This is a little difficult to explain without going into the exact details.
    I guess what it boils down to it is, if you have a method of keywords (bidding/which sites to only place ads on/etc...) for a PPC campaign, there is no way to somehow copyright it or protect it, so nobody can replicate that same exact method.
    Just an odd scenario...

    You can Patent a way of doing something, but you need to prove that it is an original idea.

    The way you are describing it though, it's more of a recipe. Though you can copyright the expression of the recipe, you can't stop someone from rewriting it into there own words.
