I think my domain name was google slapped before I owned it

I bought a domain name a few months back and built a site around it. When I started paying attention to getting my site indexed on google I noticed that there were a ton of pages indexed for my domain that didn't exist. Of course they were all just 404s now, since I didn't create new pages with the same URL on my domain, but there were around 40 of them.

I think whoever had the domain before me got the site google slapped. My site should be ranking in google. It's #1 in yahoo and #1 in bing for a certain search term that google has it completely not ranked for, and it stacks up evenly to the top sites ranked in google for that term.

So, if someone did do something nefarious with this domain name prior to me owning it and getting it google slapped, is that a permanent thing? Is there anything I can do to signal google that "hey, this isn't the same site anymore!", or is it in slap-hell forever?

  best would be prove ownership in webmaster central and maybe they will take the penalty off if their is such a penalty... are you indexed or not? If your indexed than you can only just keep building content/seo/backlinks and you should be back.

Make sure you have a quality site with original content and quality backlinks, then use Google Webmaster Tools to request re-evaluation of the site. It may take awhile, but it is possible.

If you do a site:domain.com search in Google, you can see if you are Google-slapped or just not ranking in Google... If the site:domain.com search shows even a single page on your domain, then the Google-slap is a non-issue...

As a previous poster said, check in with Google Webmaster Tools to make sure that Google knows that YOU own the site now...

  You can also try a whois search on the domain at least to try and work out when it was previously owned and try http://www.archive.org/web/web.php as you may be able to see the sites old pages and work out any prior issues.

You could also click on the "cached" link on the search results for your domain - it may still show what the page looked like (could be an error, but maybe).

If you find a bunch of junk, it's at least more of an indicator.
