Is "Terms of Service Agreement" necessary if you have commenting, sign up feature on your site

Please let us know if you have a sign up feature and commenting system on your website articles, is it legally necessary to have a "Terms of Service Agreement"?

      Having a TOS is always highly recommended.

      Regarding what other people may do - any limits on what they can comment about? Include links to?

      What if they do something that gets YOU in hot water? Including copyrighted material? Defamatory material? Linking to a phishing scam?

      Regarding what you may do or want to reserve the right to do with someone else's comments. You do realize they do not belong to you?

      If there is a claim, are you controlling how and where that dispute will be decided? Are you inadvertently opening yourself up to a lawsuit, or are you laying down a strong defense that prevents people from even bothering with a complaint?

      All this - without even knowing what your site is about. So yes, IMHO it would be prudent of you to have a thought-out TOS for your website.
