Google Website Optimizer in Germany, legal?

I have to say I'm finding the fact Google Analytics is "illegal" in Germany embarrassing for Germans. However, I am also rather worried that this may also mean the Website Optimizer maybe illegal meaning I cannot split test as easily as I'd like to.

Does anyone know if it's illegal to use the split tester in Germany / on .de domains and so on?

    where did you heard from that google analytics is "illegal" in germany? Never heard of that. I am a german too, but now living in austria but my friends are doing their adsense work from germany and they use google analytics on almost all their websites for more than a half year now and they do quite good money but never be punished for using analytics. Can you please tell me where you got i from?

    They can be fined I believe but don't quote me. I work for an extremely large German company and we are just going through the process of moving away from Analytics as a result.

    Still, I just want to know about website optimizer.

    well never heard of it but ok. But it is still only for the .de domains, right?

    Sorry but I don't have information about the website optimizer right now. I try to figure out what's with it.

    I honestly don't know. I think it's just .de domains. I heard rumours of German law makers talking about prosecuting anyone who's content was available to people in Germany - which REALLY made me laugh.

      hehe. yea the german laws are really ... ^^ it is very funny what they are doing there there is a huge amount of crap ^^

    Just thought I'd give some feedback. Split testing is legal in Germany but I'm still not 100% sure about Google Site Optimizer. Interesting stuff.
