Having a privacy policy is mandatory in the US or if any of the ads you run require it (such as Adsense, for example). A TOS is good, not mandatory (as far as I know) but without one, some users will not know what they can and cannot do, leaving you without recourse for anything not explicitly illegal in your jurisdiction. (Even that becomes ambiguous if the site visitor is in a different jurisdiction than you and you haven't stated what jurisdiction differences will be resolved in.) Look at other PP and TOSs in your niche and jurisdiction and write one that corresponds with your needs for free, or there are several on-line lawyers that have templates you can search for. 'on-line privacy policy templates (jurisdiction)'. Etc.

Thanks dude. And if I have an online shop that deals with customers from all over the world, not the US, should my privacy policy and terms of use be created by the US laws or the laws of the countries Im trading to.

And if Im located in France per say, and I trade to americans should my pp and tou be created by the US or French laws?

A privacy policy is a legal document that discloses some or all of the ways a party gathers, uses, discloses and manages a customer's data. The exact contents of a privacy policy will depend upon the applicable law and may need to address the requirements of multiple countries or jurisdictions. While there is no universal guidance for the content of specific privacy policies, a number of organizations provide example forms or online wizards.

You can get more complicated than that, but doesn't 'sound' as if you need to.
