Using the exact name of the product as the domain name.

I know this is a no-no, but a fellow warrior claims that you can use the exact name of the product as domain name and get away with it by writing the following disclaimer on you website ....

"This blog is not affiliate with or endorsed by "product name".

According to this person, by using the above disclaimer, you can avoid copyright or trademark infringement.

I don't think this true as one company made me take down all my websites and transfers the domains to them a while back (I did not have the above disclaimer on my sites).

    Each company is different, but most will make you take it down or they will purchase the domain name from you. Either way, using the product name in the domain name is generally not a good idea in my opinion.

    Some people will believe anything they hear. However, since you've already had to take down sites for trademark infringement, I'd think you would know better.

    Some site owners get by with trademark infringement - many don't. Before using the magic phrase, you might want to get a real legal opinion on how well that will work for you. Legal advice from non-lawyers is worthless.

    For long term business, I don't think that it is a good idea because the bigger companies would not want unofficial website using their names.

    However, it might be a good idea if you are looking to sell domains. In that case, such a domain with a product name might be worth a lot for a particular company.

    You are likely to lose the domain if you start
    making money from it. An UDRP and you're toast.

      I thank you all for replying.

      This is a good lesson for people who are new to IM.
      You may get away with these types of violations promoting clickbank products;but most companies will go out of their way to protect their trademarks and copyrights.

    Trademark law can be tricky, but one thing is for certain... nothing will happen to you unless the company that owns the trademark pursues you. There are not "trademark police" that surf the Internet.

    Whether that company goes after you or not is unknown. I suggest asking for permission to use the name. Many companies will allow this, but on the other hand, many will not.

    I love to say, "it's easier to ask for forgiveness than it is to get permission," but I don't think that this applies here. Ask for permission is my advice.
