I've had a pretty well known marketer NOT pay me...

by bless
17 replies
for an intro video I did for him.

I've given him lots of chances to pay, but
he never does.

How do I handle this?

I want to warn other Warriors against doing business
with this person.

Can I give his name out or what?

Please give me some advice. For once I was stupid
enough to NOT ask for prepay.

Thanks,
Charles

Can I give his name out or what?
    no.

But, you could create an XYZ scammed me webpage... then link to it in your signature.

    Charles,
I want to warn other Warriors against doing business with this person.

Can I give his name out or what?
    Nope.

The policy against that is at least 10 years old. Here's the reasoning:

We have no way to be certain of the facts about such an allegation in most cases. We couldn't do anything about the majority, even if we were certain we had all the relevant facts.

A lot of the instances in which people make such claims are the result of communications breakdowns, rather than actual wrong intent. Many others are simply lies, posted to harm someone. And some are attempts to use the leverage of this forum to force people to do something the customer wants that may not be warranted.

We have no way of knowing which we're dealing with most of the time. Given the damage that could be done to innocent people if we allowed incorrect or incomplete stories of this kind to be posted, we don't allow any of them.

Thanks a lot for explaining this, Paul.

I totally understand the reasoning behind the policy.

If its under $100 then put it down to experience, go into your spare room and punch a pillow pretend its him. Having run business in the offline world losing cash and not getting paid can be way more painful!

Trying sending them a PayPal invoice. I've done that when it seems like my emails aren't making it to them or are going unanswered. So far, it's been paid every time.

      Never hurts to try,

This sounds like a very good suggestion and the best route in this case. Its businesslike, professional and may serve as a friendly reminder for payment.

I would give a thumbs up to this. This is a nice and professional manner to handle the situation rather than crying out foul moon.

I hate to say this, but they probably will not pay. As someone suggested put up a web page about it and you could also post it on imcops.com.

I agree - take the normal legal routes open to you in your country. Most big companies automate or make these standard company procedures - so there is nothing personal about it just a standard procedure to chase unpaid debts.

Forget that he is a big name and I disagree with this "set up a website" stuff - it's a waste of your time and may backfire. In the long run having a standard procedure for your business (can be a one page .doc reminding you what to do) will be more efficient and you just do a standard follow up when someone doesn't pay within an agreed number of days from the invoice date.

For small jobs require an upfront payment or deposit, OR, as someone suggested hold back the goods until payment (even if you have spent your time). Or create a low-res video to show you have done the work and release the hi-res on payment.

For big jobs you can use milestones. Each time a delivered part of the project is completed ask for payment, and don't carry on working if it is a late payment.

Obviously for some customers you may make an exception if they have a good history and they call you up to explain what is going on - it's always your call.

    The one time, right? Sucks.

Try all the methods mentioned above before giving up. Persistence can pay off. However, don't lose time to new projects while you seek repayment. Especially of it's a small amount. Most of these issues usually occur because the other party forgot or never got the email. Better gurus have support desks that drop the ball, too.

Hopefully, the video isn't being used. If it is, you'll need to issue a DMCA notice since it hasn't been purchased and copyright properly transferred.

    Good luck.

The last two jobs I got here ended up being a joke.

One vanished, and I had actually invested money on that project, $50 bucks in a highly customizable WP template.

and the other... well, that was fun, worked the price under my bottom line and, then came back for more so I ended up refunding the payment and keeping the material. There were reviews of the basic autoresponder services so not a problem with dark niche material (which you can´t reuse for basic ethical reasons). Still didn´t use it actually. Someone want PLR reviews? lol

But it was ok... they actually gave me the kick I needed to leave service and jump.

I'd be careful with that. No one likes smack talkers, right?

It might feel right to warn others about this, but if it's a well know marketer he or she most likely has a list, and those with lists have authority.

In other words, it could work against you.

In my opinion, use the time you'd spend giving someone a bad name to make up for the time you lost.

Next time, don't deliver the video until they pay. That keeps the motivation on their side - they know they need to pay to get the files.

If you're worried about them taking it when you show it on your own site...you could watermark it...

        I know I know...hindsight is 20/20.

The only thing you can do is keep the lines of communication open somehow, or move on in your head.

Interesting advice - I need some for a situation in the same topic.

I recently gave an Active (regular poster, WSOs, etc) Warrior Member a 50% deposit of $500. for a project and deliverables were promised in a week.

Now, more than 6 weeks later our project has not moved forward an inch after several unfulfilled promises from the programmer.

The programmer/WF Member has suddenly stopped all communication after I finally (and politely) asked for a refund. (I tried emails, calls, PMs on WF)

We have hired another programmer and just want to move on.

How would you handle this? File with PayPal for a refund?
