Adsense Unit Near Navigation Bar

Hi all,

I found a website I would like to model the site I am about to create after, but I notice that the site has a left nav next to an Adsense ad unit. Wouldn't that be a violation of the Google Adsense program policies? Please take a look at the website I refering too here: http://www.acne-removal-scar.net/ , and please share your thoughts on the adsense ad unit near the left nav, as far as Google's policy regarding Adsense ad units is concerned.

    The main content area on most websites is surrounded - on one or both sides - by navigational elements of some sort. Why would this be a breach of their terms of service?

    Disguising ads to look like your navigational elements is prohibited (since you're misleading people into clicking ads against their will), but from what I can see, this isn't the case at all here.
