What is a privacy policy and disclaimer?

what is privacy policy?
what is a disclaimer?
do i need both on every site i create?
How do i get/write them?

    A privacy policy states what happens with all the data you collect from your visitors. Even if you think you don't collect any data, you do. Even if it's just some log files that your webserver (or that of your hosting company) generate. And yes, you need one

    A disclaimer protects you from legal trouble by denying that you are responsible for anything that might happen due to your visitors visit of your website. It's recommended, as well, otherwise you'll have to take full responsibility for everything.

    You can use the Privacy Policy of Automattic (the guys behind WordPress) as a basis for your own. Privacy*Policy « Automattic. Modify it so that it fits your needs. Regarding the disclaimer... That largely depends on the site you are creating. If unsure, seek legal advice.

    What they are has already been dealt with so I will concentrate on the latter. Do you need them? Yes. The US is a litigious society and you do need to set out what the rules are when people visit your site. For example, minors (under 18) are excluded from my sites for legal reasons in the TOS. This is for an education site so don't go thinking that is a good idea just for adult sites.

    How to write them? Get professional help here. Either pay for an attorney or find one that has a good generic template. Just run a Google search.
